Payday Loan Help in CA

I have the following Payday loans and I need help. I have faxed and emailed letters telling each one they no longer have my authorization to debit my account. I cannot close my checking account since I have an issue on Chexsystems so that is not an option. I called Dept of Corporations in CA and they all say they are not licensed to do business in CA. All are online. I am willing to pay those that are not paid in full but on MY terms via western union or money gram. I am dying and now falling behind on everything! Please help me. I have no idea what letter to send to stop any "paper" checks they create or any wage garnishements? PLease I need help out of these.

Paycheck Now $1000 Loan, have paid $1587.50
Cashnet/paydayloanyes.com $250 Loan, Have paid $375
Geneva Roth $300 Loan, Have paid 270
United Cash loan $300, have paid 270
500 Fast Cash loan $300, have paid 270
Epayday loan $350, have paid 315
AIP loan $200, have paid 178
Impact Cash loan $250, have paid, 75.


Forgot to say also that my bank is already pissed at me for some overdrafts and said if I incur one more they will close my account. I cannot have that happen and just want to make things right. I have registered now so if anyone can help please send me any forms I can use. I am in desperate need and just want to make the debts right.

Th, althoug you have revoked debit authorization , this will not stop the pdls from debiting. THey will continue to debit or put paper checks through no matter what letters you send. Your only option is to close or hard debit block the account. If you go to the banking fourm on the main page, there are lists for banks which will deal with someone in your situation. You can post your situation on there and the two moderators as well as other members will help you with that. You can close your account, even with cexsystems issues. You have got to close your account to protect your money...that being said The pdl's do wage assignments not garnishments. Wage assignments are voluntary and garnishments are court ordered. You need to do an additional letter revoking any wage assignments you may have signed. Nothing fancy, just type out that statement and sign it. Also be sure to give copies to your payroll department. Please look at the banking fourm and take care of your account first. Once your account is taken care of, post and we will help you write your letters making payment arrangements with the companies.

theiqbals-I have a letter all set up with the California laws ( I am in CA myself). Please let me know if you would like it.

Also,about the wage assignments...there are certian contingencies in many states in order to make a wage assignment valid...in California, one of them is that a spouse must sign if you are married and your HR dept must agree to it ahead of time prior to the money being given to you.

Well, just talked with Geneva Roth and they are refusing to stop the debits. They say I have to pay on the due date period. I told them they were illegal and the CS person said there was nothing to do. I left a message for a supervisor stating all the lingo about them being illegal and that I have refused them from debiting my account and by law they have to stop. We shall see. The manager was due back in 1 hour. Not starting so good here.... I did call my office and told them I need to cancel my DD and that has been done, they will do a paper check. Just need to figure out how to handle this with my bank.....

Well, I am getting discouraged. I have opened a new account with a bank and hope they will not run Chexsystems. I did it online. I will get a paper check from my work and will be closing my account at my current bank. I had a LONG talk with the supervisor at Geneva Roth and she said well go ahead and file your complaint with the AG we are licensed in Utah and you signed the agreement saying so. What can I do... no one is agreeing at all or willing to accept my terms?? They also refuse to stop any debits even though they say they rec'd the letter of revocation?? HELP I am stressing out that they will start calling my place of employment and harrasing my boss.

theiqbals, I know it was difficult but good going opening a new bank account....As for the old one. Geneva will continue to try to debit. You need to get it closed asap. They may even try to debit the whole amount you owe. Stick to your guns. Keep repeating everything you put in your letters and do not change your tune. Try not to communicate with them unless it is in writing. You want everything in writing for documentation for your complaints. Unfortunately they will call your work and may even call your supervisor. Can you intercept the calls or arrange to have all calls in reference to you put through to you? As a last resort, you may want to tell your supervisor. I am going to pm you something....

Ok, Impact cash has agreed to my terms and I will be paying this off on Friday. One down. Now for the others, I have filed all files with the BBB in their area and am mailing the Dept of Corp (AG) the letters of complaint. I spoke to them at length yesterday and they were very adamant that they are illegal no matter what I signed and that they will take to to action immediately and get this taken care of. Thanks again for you assistance. I just want to take care of these by paying the principal owed and move on.

Hi,
I am also in California and did deal with Geneva-Roth, which tried to take me to arbitration. I would definately get the Dept of Corporations and the AG involved on this one. They are totally illegal here and the more complaints that are filed against them the better chance we have of banning them from the state completely.
I was able to get a settlement with them which was good.

Thanks KS. I already sent all the BBB info out and have been sent emails on them all saying they have contacted the companies and are awaiting response. I am filing all the DOC/AG paperwork tomorrow. I am just wanting to be done with all of this and move on to better financial managing! Thanks for the support.

Just wanted to update you. By the grace of God my largest debtor called me today and left a message on my cell saying they rec'd my letter and have settled my account as fully paid and satisfied. I am so glad. Granted they now owe me a refund that I will probably never see but that is ok. Live and learn right. I am just glad that 2 are now paid in full! Two others contacted me with one being a JERK and hanging up on me after threatening me with collections. I emailed them both a copy of the letters to their direct email addresses and never heard back. Just praying the others close me accounts as PIF as well. Thanks again for your support in this group. You guys really are wonderful people. My situation would not have improved if you guys had not been here to help.
