Ellis Crosby is asking for money or they will arrest me

Hi, welcome to the forums. Please be aware that Ellis Crosby & Associates are currently under invesitgation for unethical practicing.

They have been using the "arrest" tactic to scare people into paying more money and on that day they call.

Please rest assured that no one will be coming to arrest you.

You might want to lodge a complaint with the BBB and also lodge a complaint with Summer who is with the Attorney Generals Office of Flordia. She's currently working to get charges against the company.

Also there's a good chance the money they are collecting are not clearing peoples credit file. Make sure you cease contact with them and ask for validation of the debt. If you do speak with them on the phone, try to maintain your ground. Remember you're the one that should be in control of the call. If you have a recorder available, try to record the call of them harassing you.

Sammie, there are lots of postings regarding Ellis Crosby & Associates all through this forum. Read through them, there is good information that may help you in dealing with them.

Threatening arrest is an illegal tactic commonly used by these thugs. And thugs are exactly what they are.... they claim to be a collection agency, but they nothing more than common thugs.

Don't forget to file with your local police as well.

Debt is a civil matter and will be delt with in civil court if it reaches that point. Illegal debt collection tactics are a criminal matter and will be delt with in criminal courts. Be sure to follow through with any reports, these thugs need to be brought to justice.

I was searching for Ellis Crosby & Assoc. on the internet. And the search landed in your website. The reason for my search was that Ellis called me and I was looking for the validity of the call.

The receptionist in my office informed me that David Wakefield who claimed to be an investigator with ELLIS CROSBY & ASSOC was looking for me. She asked me the reason of his call and it seemed that he was very persistent to get information about me. When he realized that his call was landing nowhere, he became very aggressive and was threatening of lawsuit filed against me. He also told her of some ssn number and my last name which I had no idea. She dismissed the call and informed me about it.

After knowing the purpose of the call, I tried to contact the company in Florida and gather the address and to my surprise they were not willing to give any type of their information.

I guess he will be looking for his next victim. I presume that they should come to this website before they allow themselves any grief. Don't let it be You

I was called by this company, they informed me that I would be prosecuted, it was a class III felony, and that I was going to jail, and that my name was going to be continually called, and harrased til payment was due

I would suggest making a complaint with the BBB and with Summer who is with the Flordia Attorney Generals Office. They are currently under investigation and should of been shut down already. If you are still getting calls, right from the get go tell the call is being recorded. Ask them if you are tying to collect on a debt, then please send validation. Although I'll tell you right now, if you pay them---chances are it won't go towards your debt. Someone made a post about how they paid ECA, and then the account got sold to another agency who then tried to collect.

Just remember Debbie, there is no debt jail. It is not illegal to be in debt...and let them know that you are aware of the laws. Ask them if you need a refresher course!

Whatever charges they have put on you is false and malicious. Ask them to prove the debt for what they are making the claim.

I read somewhere else in these forums that David Wakefield is no longer with Ellis Crosby. Someone called them and they said he was no longer with the company. Oh well, I got word from my attorney yesterday that he filed my lawsuit and that Ellis Crosby has been served. We are now just waiting for their response. I suppose I will be going to court soon and will get to see just who this "DAVID WAKEFIELD" really is.

I have contacted Summer at the Office of the Attorney General in Florida and I was forwarded to a voicemail to leave my information so she could send me the affidavit form to fill out. Has anyone else completed this form? Does this mean we can get these people. I have given them money twice, once via Money Gram which I don't know if they every picked up and the other via Western Union which Western Union says a quick collect is sent directly to the company and they cannot advise if they received the payment or not and I should contact the receipient which we both nows what will happen if I do. I have called Ellis & Crosby several times asking for a letter stating I have been paid in full and as of today have received no such thing. I will not pay any additional funds until they forward me paperwork and the next time they call. I will state forward me documentation stating what I owe and how much, etc.

Thanks to all of your for your assistance but I just wanted to see if anyone else is getting anywhere with the Affidavit form or getting their funds back that they forwarded.

I received the Affidavit from the Florida Attorney General's office about a week after I filed a formal complaint on their website. I had also left Summer a message, but that was over a month ago. She just called me back yesterday, so I am sure she is quite backlogged. If you havent already, file a complaint against Ellis Crosby at the Florida AG's website at myfloridalegal.com as well at your own states AG. This may speed up the process of your getting the Affidavit.

The Florida AG is going after them on very serious charges and hopefully EC will be put out of business altogether, but in the mean time, stay on them to get your payment receipts. They may not have even applied your payments to the original debt. EC is under investigation, so I am sure the AG will find out if they actually are applying payments to the original debts or if they are just pocketing them. From what I have heard from others on this forum, they paid EC and then got a call from another collection agency trying to collect on the same debt, saying no payments had been received or applied. So it sounds like EC is just keeping it.

Please give me the AG address so I may file a complaint. I sent them $1120 for two payday loans because of the threats they made to me not knowing about any of this going on.

She sent me an affidavit to fill out and I will be forwarding this after I get it notorized tonight.

You need to file a complaint on the Attorney Genral's website in Florida and then it will proceed to obtaining the affidavit or call her and leave a message as I did.

Does anyone have a feeling that we will get restitution for all of the grief that they put us thru? I know that I made a mistake by obtaining a payday loan and believe me I have learned my lesson well.

I hope there is some restitution. Ellis Crosby is apparently not worried about any monitary restitution or fines in the lawsuit becasue they continue til this day to harass, lie and abuse consumers. I guess they are trying to get as much money as they can before they are ordered by the judge to pay up.

I want to pay my debt but I want to have back the extra money that I paid b/c I was scared and didn't want to be arrested. I still get the chills every time I hear a police siren thinking that they may come after me b/c Ellis & Crosby did not pay my debt and kept the money.

Has anyone heard anything about resolution or just affidavit filing and talking with the Attorney General as I have been doing.

Ellis is not going to arrest anyone. They threatened me and I WORK for the government. I laughed histerically at them. They said THEY were going to fire me and take my possessions, etc and so forth.

THey're using scare tactics, gardnerjl. The best (or worst) they can do is harass you. In which case, you ought to complain to the FTC and the Florida Attorney General.

I have filled out my affidavit and am mailing it today on Ellis & Crosby. Has anyone heard what has been happening with the law suit because I wanted to know if anyone thinks we'll get restitution for our stress. I STILL cringe whenever I hear a police siren.

Gardnerjl, Ellis Crosby is convicted because of their illegal actions. Sooner or later, they will have to shut down everything. This fact is widely spread everywhere.

You don't need to cringe at the sound of a police siren. This thought will keep disturbing you. You are admitting the fact that you are willing to pay the debt but not to someone who will pocket your money and not pay to your debt account.

I think that you should not tense your life to the maximum. Instead you should live happily hoping for a better future. :)

Yes I am willing to pay my debt but looking back over it, I have given out well over what I owed. I only borrowed a little bit of $$$ and ended up paying almost $2000 to clear the debt that now may just be fraud activity by a company who does not pay the actual person that you owe.

How do I find out if the payday loans were paid b/c Ellis & Crosby has never sent me any loan documents clearing my name like they said they would.

gardnerjl, though you might not see positive results because of Ellis Crosby's activities, but still you can pull your latest credit report from the three bureaus and see the latest standing of your account.

The payday loan company was paid. Usually a collection company will buy these accounts when other companies cannot get their money back.

Check your credit report. If the item still appears, you can dispute this item, and show your receipt as proof.

I pay for freecreditreport.com, who is affiliated with Experian. Although I have to pay (the fees aren't too bad), I get to see my credit reports (all 3) whenever I need to. Credit scores and reports certainly change a lot more than once a year! They alert you of negative information, score changes and inquiries.

I feel so stupid, I wish I would have found this web site yesterday, before they threatened to have me arrested on fraud. I money gramed them my rent money to avoid this and found out now I never should have sent any money! I will be contacting my local AG anf Florida's also!

Welcome to the forums.

Keep the receipt of the money gram in safe place. This is a very important proof of your payment made to Ellis Crosby.

It might happen in the later times that some other collection agency will be contacting you for the same debt. You can produce a copy of this receipt to confirm the payment made from your side.

Also, you should report this activity to the FTC, BBB and the state attorney general office in your state.

Don't be discouraged if it seems like it takes a long time for either the State Attorney's Office or the Office of Attorney General to respond to your complaints but it seems that the rate of financial crimes are on the increase right now. so have patience. but follow through.

I got on line and obtained all three of my credit reports for free. I saw that I only have one payday loan on there so I am not afraid to answer the phone to Henry Jay at AS Associates who I paid another loan off thru. If he calls and threatens me now I know that I have some time to pay the loan off and it is not as urgent as he makes it seem. I know I owe this one more payday loan place but then I believe I may be in the clear. There was one more I thought but I have received a phone call and it is not on my credit report so I think I am OK. I think that most of these companies do report you if you do not pay them off, correct?

Thanks to everyone for their advice on where to get my credit report and for this forum that has helped me not to be afraid to answer my phone or the knock at my door. I'm still afraid when I hear police sirens because of Ellis Crosby's threats and the money I sent them has paid off my debts? I am so out of funds right now I can barely stand it.

I don't think we'll ever see the extra money we gave them (whoever else out there paid them too) and I don't believe the Attorney General's Office will ever get a monetary settlement but at least I have piece of mind in knowing I'm not alone....

I recieved a call also from Ellis Crosby stating I owed $650.00 for a pay day loan I was default in. They also stated to me I would be going to jail for computer fraud and something else if I didn't pay the money today. They also said my company that I work for would be pressing the charges. When I talked to the company I was in debt to my bill was only $535.50. This company (Ellis Crosby) needs to be shut down and us as victims should be reinbursed our money they stole from us.

You will get some more information about Ellis Crosby and their illegal activities after reading this topic. Please have a look and know how they are using different names while collecting money.

Any legitimate company will not make threats or do anything that sounds illegal in the eyes of law. Look for a company in the BBB and the FTC and see if there are any complaints filed against them. This will help you to know some more about the company.

The collector must be contacting you for some of your past debt. Ask them to validate your account as it is your legal right to know its details. If they are unable to give you the necessary details and still continue to contact, they are in violation of the consumer protection afforded by the fdcpa. You can sue them with a class action lawsuit and recover the extent of damages done to you.

There are many other topics relating to this company in this forum. Read it and know some more about the illegal things committed by them. Lots of people have submitted their complaints at the FTC, BBB and the local attorney general office. I suggest you to do the same.
