Disability income freeze bank account

I found out today if your only income is from disability income that the income cannot be garnished,but there can be a freeze placed on your bank account,is this true i do not know,hope someone else can vertify that.i am sure a lot of peole wold like to know for sure.i contacted a debt counciling service for disabled,they tod me to send them 200and 20 dollars a month to keep the creditirs off my back,yet the debts are never paid off. Susu


A freeze must come by way of a "Levy" or "Attachment" the bank must notify you unless the order is Ex Parte.

When they notify you, you must object to any levy or attachment on the basis of the property being exempt property.

There are only certain things that can have the disability attatched to such as child support, I believe and any debts that are owed to the federal government I believe. Other than that I don't think they can touch your disability.

disability income is 100% exempt providing you are not also earning an income in addition to the disability which exceeds your states exemptions. This is for limited disability only.

If you are fully disabled, and the only deposits made to your account is disability income then they must release the lien from your account immediately. You must contact the 3rd party who placed the lien and also contact the attorney who had the account frozen. You will get back 100% of your money as well as your account access to your checking and/or savings accounts.
