United Legal - Payday Loan Question

Anyway, are these agencies able to say "We can't take a payment arrangement unless its done by checking or savings account"? They said if I want to pay by credit card or money order, that it would have to be the whole amount. Is that legal?

I have dealt with this agency before, beware. My suggestion to you is to send them a debt validation letter. Tailor it, don't use the template found on the website. Say its ok to contact you in writing. If you do speak to them on the phone, and its legal in your state, record it. They say a lot of things that are in violation and they are quite aggressive. When I sent them a DV letter, they left me alone.

I think it is illegal to demand payment via check or savings account. Check the Texas Finance Code, this where you will find all the laws regarding lending and collections. I am in Texas too, but not familiar with United Legal. Do some research on them and find out exactly who they are. Are they a collection agency or an actual law firm. I can bet they are just a collection agency and if so, they are mispresenting the nature of their business by using "legal" in it. That is illegal too.

I dealt with United Legal. I didn't have a problem with them at all. They were very easy to deal with. They broke my paymnets up into 3 payments a month apart. So I paid them the balance over 3 months and it wasn't an inflated charge it was exactly what I owed.

Welcome to the forums. As you are willing to pay the amount, you should have proper details of the said debt before you pay anything to it.
Once they have validated the debt and that you are willing to pay it, there should be no problem in accepting the payment in anyway. Make sure that you have proper receipts of your payments and do all your correspondence in writing.

I have one of those damn payday loans I couldn't pay back, needless to say I won't do it again. But had to flee Houston due to Hurricane Rita, today is my first day back at work and this guy has left messages the whole time I was gone. Finally left him a message telling him our circumstances and he said call when you get back, he seemed understanding in his message. I fully intend to pay them back but have read on this forum about splitting up payments. I need more info on this "debt validation Letter" I read about above. What is it, what does it do, etc.

debt validation is a very important tool to know about your debt in legal terms. Under Section 1692g. As per the Fair Debt collection Practices Act, you can force a collection agency to present the true picture of your debt specifying the total amount, calculation of the interest.
The debt validation letter will prove that the debt has been legally owned by the present collection agency from your creditors. It will have a copy of the agreement letter that the creditors have entered into a contract regarding the debt payment.
It will also prove that the said collection agency is licensed to collect debt in your state. The agency can also force you to pay the amount if it is within the Statute of Limitation period.
Once you have asked the collection agency to validate the debt, they are required to submit the necessary information within 5 days. If they are unable to produce the details, you can refuse to make payments due to lack of proper details of the debt account.

I have some of those payday loans as well. My husband just lost his job and we are now living on my income. Some of them are calling me and saying that if I don't pay the debt or make payment arrangements ASAP, they are ready to file on me. I live in Texas and my understanding is that they can't sue me for the debt.
Is that true or can they all take me to court?

Welcome to the forums. Any agency has the right to take legal actions if the debt is proven and is denied to be paid.
You might have two options: either you can send them a cease and desist letter to stop all communications with you or you can take the help of a consultant who will deal with the said agency till your debt is paid.
Leaving your debt unattended will add sorts of financial charges and also, will hurt your credit lines. I will suggest you to settle this amount as early as possible to avoid further harassments.
Keep sending them something each month so that you are not in their list of calls. A debt consolidator will be able to handle them professionally as they are trained for these specific purposes.

Did you send your cease and desist letter certified? If you haven't, make sure that you send it certified this time with return receipt requested. The benefit of doing it is that you will be able to know the date when they have received your letter by hand.
As stated in the letter, you have asked them to stop all the modes of communication and if they still continue, it will be a violation of the fdcpa law. This will give you enough room to take legal actions against them with the help of your attorney.
If you face any problem in between, just let us know. I am sure they will stop contacting you after you have explained your intentions in the letter.

The lenders want to recover money from you as soon as possible. They will possibly try to prevent your account from becoming 'charged off' and going to collections.
At this stage, offer some money in advance to them along with a letter of your payment plan. This will give them an impression that you want to pay it but are going through some financial hardships. They will understand that you will pay more towards it once your situation improves and clear this debt faster.
Send your correspondence through certified mail with return receipt requested. You will be able to track down all your correspondence made with them and have a proof of it.

I have explained to a Mr. Maloney, who may I say is not an awfully nice or understanding person! He's in fact very arrogant and rude for starters...........
We have have been victims of identity theft and have alot of people to pay back because of bounced checks. I said today when I got my social security check I would send $100.00 (my loan has a balance of $300) but as it turns out I will not be able to send more than $50.00 this month. Possibly pay it off or half of it next month, This is the best I can do. He keeps threatening me that if I do not send money he will turn it over to be filed. If someone just cannot pay a larger amount at this point, do they have to accept what we are able to send? I want to pay this money back more than he wants it back just unable to at this time. Appreciate some help with this matter and if there is another person I can deal with besides this Maloney character???

I feel for you. Though there is no rule that the collection agency has to accept what you send in your payment, but your effort will really matter. Let the CA insist for the full amount, send what you can afford from your side. Send your payment through check and certified mail with return receipt requested. You will get a green copy signed by the company. If they cash the check, your proposal will be considered as accepted. If they don't accept your check, the green copy will prove that you tried to pay the account.
I wonder if these CAs will take the matter to the court. But in case, if it's done, you will have proof of your payment efforts. The judge will surely make decisions in your favor.
Have your got your debt validated from the CA? You must review the details before making any commitment to pay the account. You should be sure that the company is having your legitimate account details.

I dealt with them and had only one problem, i made arrangments for several payday loans with them to be paid off..... However, I kept getting calls from my rep telling me I didnt pay when I did pay! I called everytime and gave a number to them from Western Union.... I did everything according to the books with them... Im glad that 4 of my loans went to the same company because they were able to break it up into 6 small payments.. It was nice... However the first time i called she told me i was facing jail time, ( i am involved with the ellis crosby deal) so i am alot smarter than that.. I told her that I know that I CANNOT go to jail for it... And i am not retarded, and I know she is just trying to get paid, which I am willing to make arrangments for my debts.. And Several times after that she called again, saying when are you going to pay, but we have the same arrangment each month so... But other than that I was willing to get all 4 loans paid off and everything worked out fine... I am thinking now about dealing with T&C to get rid of my other loans... Im still not out of the hole, and its been since 2004 :)

I have 3 payday loans, 1 of which, i had almost paid off, but i was out of work for couple of weeks with a staff infection in my hand and had no direct deposit that last week of december and then the first of the year, our company stopped issueing our checks direct deposit! I e-mailed the 3 payday loan companies and explained what had happened and asked them for their addresses to send the payments and they refused to give them to me and are calling at work and one time called 15 times in 20 minutes and i wasn't even there at the time and they harrassed our bookeeper and when i got home there was a threatening message left that said' "tell rose your bookeeper at work, that i will call 100 times a day until you pay this in full!! Now they have someone called united legal calling my work and harassing me!! I have told them i will pay in payments but they are unwilling to accept it!! Can a company such as yours get them to accept payments?? How can i get these threatening calls stopped and stop garnishment of my check if they choose to go that way??
