civil action by payday loan company

I was contacted yesterday by an agency hired by a payday loan company (my cash now) to sue me in court if I don't cough up $1100 by this Friday. I have learned a hard lesson about payday loans, and had several. All of these companies except for this particular one were willing to negotiate a settlement/payment of sorts. They are now threatening to have my wages garnished. I found out since I originally took out the loan that my state (Louisiana) limits loans to $350, yet I was able to get $500 from them. Will that give me any leverage in court? I am pretty freaked out right now about this because this just couldn't come at a worse time for me financially.


collectors forget that they are dealing with people, harrasing, threatening, and be-littling. If the so called legitimate collectors are right in persuing a debt and the debtor has made it clear that they can not or will not pay there over inflated loans off, then take it up with a court of law or shut-up and move on to someone else

Yes, people are at fault for defaulting. BUT some of these " collection agencies" do business on the hope that the people they are calling are to stupid ( no offense to anyone, I was stupid with bad collectors too once ) to know that they are breaking laws.
And we aren't talking about credit card's here. We're talking about illegal and legal payday loans. Most people who are dealing with "collection agencies" on THIS forum have over paid on a loan that was illegal to begin with.



I guess the question is, if you knew that the loan was illegal why did you take it out? Was it your intention to steal from the company that gave you the loan. I also don't agree with the way some of these agencies try to collect on the debts. There are some nice representives or collectors should I say. I guess those are the ones that have a job to do because they have a family to support. But collect with morals for the debtor, when on the other hand there are the ones that lie to you and expect you to fall for the bull. I am also a collector, that as well sad to say have some debt that I am also trying to clean up due to hard times. So I can relate to the debtor as well as the collector. You will be surprise to see how many people take out these loans and had no intentions of ever paying it back. It makes it hard for the debtors that really want to resolve the debt. Because the collector feels as though they've heard that same ole same ole before. However, it doesn't give the collector the right to break the law. Either the person is gonna pay the debt or they are not

sorry,but most if not all people who take the loans are desperate to try and get through a tough situation.also most like me have overpaid on these loans.btw nobody researches these places until they step out of line.then the collectors of these illegal loans practice foul means to try and get more money.threats like arrest,immediate garnishment,etc.soto summarize every point you made is wrong oh so wrong.except for the last part.nobody has the right to break the law.the only parties doing thatt are the pdl's,and the people who try and collect them.
