Yes I had interaction with this company and they threatened me while I was on medical leave. They called my employer and asked for my supervisor and stated they would come in and get my hard drive to confirm that I had done the payday loan and begin the court process if I did not pay over $1000 immediately. Now they have come back for more $ saying they did not collect it all at once. I have posted to the Attorney General and FTC yesterday regarding a complaint.

Well kudos to the people of this board, for getting info the right people! If it weren't for this board, Ellis might still be harassing people and doing illegal business. Their "website" has been "under construction" for quite some time, I see....

Just wanted to know since the law suit was filed does this mean we'll get justice. I mean I know that some or most of us had issues that arose that caused us to have financial situations but it does not mean that we are not willing to rectify the situation but with someone reputable not a pressure jail threatening company that makes you feel like your life and well being are being threatened. I have paid over $2000 to this company and received my paperwork from the Florida Attorney General's office (Affidavit). I intend to proceed and get punative damages for the stress I felt due to this situation. I am not a deadbeat and neither are most of the people who have been mistreated by Ellis & Crosby. Everyone has difficult times that call for reputable companies to assist us in becoming financially clear.
I hope everyone does as I have done and that we will see justice. Thanks to all that assisted me in getting some satisfaction, now being rest assured that the money I paid went to the payday loans I owed and the return of the extra fees to my wallet would be great and would make me content.

If you read the numerous posts in this forum, you will realize that representatives from Ellis Crosby have been trying to pressurize the people into paying quickly. Their main intention in doing so is that they want you to send the money without any documentation so that they are able to back up their claim against you. This is certainly illegal as per the law. Any company has to send a notice in writing whenever it is requested. You should always be alert and suspicious and lift up your red flag whenever you find any company refusing to send supporting documents of the original loan and the fees involved in it.

I know that you should always ask for documentation, I guess I learned a hard lesson. I have filled out my affidavit to forward to the Florida Attorney General's Office but will that really bring resolution to this situation? I am out tons of $$$ money that I never borrowed. I borrowed $300 at top most from several payday loan companies but no where near what I have paid to Ellis & Crosby. Anyone else forward the Affidavit and if so does it get you anywhere or is it a waste of time?

If the consumers like you would not have filed their complaints against the said company, then we would not have reached till this point where people can very boldly say to the company that "Hey!! We know that you are doing illegal business. You just can't out our money."
It is because of the efforts of each and every individual that this company will be out of business very soon and will be paying penalty charges for such illegal acts. At the same time, it is likely that you all will be compensated also, provided if the government is kind to us.

I hope that we all get our debts paid for the payday loans we took out and had circumstances arise that made it impossible for us to pay back on time but we intended to pay the bill just not with triple the amount due overnight or in the same day with threats of arrest and being harassed at work.
I am thankful that I found this website and for all those that assisted me.
Here is hoping that we all get back the extra $$$ we had to pay and that we will have the debts erased from our credit history.

We also should save all the receipts, the correspondence letters etc. in safe place so that it can be easily available afterwards. We should also take legal help from the lawyers to make our case stronger.

I just received a call from Ellis/Crosby, from a gentleman names "Jason". (whether or not that's his real name, I don't know)- stating that they were having a sherriff coming to arrest me as we speak. Now, I know that they are being prosecuted. The thing is, is that I contacted the Attorney General's office, spoke with Carla, and she sent me to the attorney generals main officer (amy), and carla stated to leave a message, and to have an affidavit sent to me via fax or mail to sign against this company for harrasing me. I have not paid any money to this company, but the 1st time they called me, I was about to jump out of my skin, sleepless nights, thinking "i'm going to jail"... etc... So, I think the mental anguish i've suffered for the past 3 weeks IS ENOUGH for me to let someone know how bad and illegal their tactics are.
So, for you who are out there thinking you're going to jail, it's a LIE!!
Just wanted to let someone know that the good guys (ATTORNEY GENERAL'S OFFICE) filed a court hearing on them on August 25th, 2005 and it should be going to court anytime now. THey are in deep ****, and they know it.

I recently had to deal with these horrible people. An investigator Roebuck started calling my husband's place of work and making threats. I tried to call to find out any information and give the man the proper call back phone numbers to us. He was rude and obnoxious. He wouldn't take any information from me and wanted to speak to my husband. We called him the next day, and he had already called my husband's boss and made it sound like he was in jail for fraud. We are in the middle of a BK and our lawyer handled this very well for us. Bottom line is....these people are just a collection agency that has a big vocabulary. They try to intimidate you into paying. They are in no way affiliated with the Florida District Attorney's office.

No they are not affiliated with the Florida District Attorney's Office but there is a pending lawsuit that I have sent in an affidavit to become a part of. I believe that you should do the same.

"This letter will serve as a response to the complaint submitted by Ms. Jodi Gardner. Her greivance has a number of discrepancies with the accuracy of how we conduct our business of collections on an everyday basis. Furthermore, some statements in the complaint are complete fabrications that I need to address.
It is a fact that our office did contact Ms. Gardner on or about the date of September 14, 2005. It is a fact that we attempted to collect a debt from Ms. Gardner. However, it is untrue in every fashion that we advised Ms. Gardner that we intended to have her arrested as some sort of criminal investigation brought about my several unpaid, unsolicited personal loans initiated off the internet with our client. This claim brought by Ms. Gardner is completely preposterous.
The business of collections is a difficult one, in the fact that there are hardly ever any satisfied customers. Many times the collection conversations undertaken by any collection agency can become combative in nature and difficult for both parties."
As you can see I have been made out to feel as if I have done the wrong thing when I never denied owing the money just the way the collection agency approached me and threatened me.
Any thoughts on this by anyone. Do we still have a chance with the Florida Attorney General's Office?

The attorney general from Ohio has responded to what was submitted to them by Ellis Crosby. They also understand as it is clear from their post that you have brought out the company involved in illegal activities.
Moreover, there are large number of complaints against Ellis Crosby using threats of arrest and they just can't deny it though one single complaint of yours.
I assume that the Ohio attorney general was not able to take many actions against this company as it is based in Florida. But the Florida attorney general has gone far ahead with this case and we will be hearing from them very soon.
Keep up the good work in bringing out such companies not following the federal laws so that some authorities are able to take actions against them.

As we all know that Attorney General Charlie Christ has filed lawsuit against Ellis Crosby and the court hearing is supposed to take place in the month of December, he commented that the tactics used by Ellis Crosby against the US citizens couldn't be described in words. They were harsh on the people and posed as police and charged illegal fees. Ted Ellis Crosby was in violation of multiple laws of the fdcpa and has to face legal actions surely.

Do you know the FTC filed penalty charges on NCO collection agency some time back? The company was charged $1.5 million for illegal activities like re-aging the accounts, reporting later than actual dates of delinquency. Now, NCO has to show every agreement to the FTC for supervision. I hope the same for Ellis Crosby too.

Does what you state, Ben, mean anything to us? I do't believe that we'll ever see that extra money that they charged us. I have learned from my mistake but it would be nice to have the fee money that they overcharged me back and not only that but the piece of mind that no one will ever scare me or treat me like they did ever again!!!

Any idea on how long that took to get restitution since this really has not gone to court and won't until next month, correct. It would be really nice, I'm sure everyone who has been attacked by these people to have this money for Christmas.
