I had a bank garnishment last week, from weltman & weinberg. I work out the country the last few years, when i came home in sept. I saw a judgement on my credit report, cause i was trying to work on fixing my credit. I did not know what the judgement was for so i called the creditor which was a credit union. Regarding an old credit card in 2001. I asked for validation and let them know i work out the country could the please send as soon asap. Of course i did not do it in writing. Now here in dec. Im garnished. I put in for a dispute. Im to return from the country on the 20th and they gave me a court date for the 28th in ohio. But im also a resident of arizona. Also the account was a joint account with my mother and they also seized my daughters account. And child support payments are in this account. Who do i contact for help, and do i have any rights? Also not to mention before leaving ohio i payed for a bankruptcy and the papers were prepared but due to getting a job out the country we were not able to get a court date. Then never returned to ohio. I called the lawyer to see if the credit union was on those papers. He said yes. But since i never filed it dont help. Is this true?

What state did you open this account in?
Also, it sounds since you never received the summons you could probably get the judgment vacated due to improper service and in fact it may be past the statute of limitations and thus a time barred debt. (meaning they can't sue you for it)

Does your name appear on your daughter's account? If not there is no way they can legally levy that account and they can get in some big trouble for it.

They shouldn't be able to seixe your daughter's account unless your name is on it, too [joint account].

Also, what do you mean when you say "AND CHILD SUPPORT PAYMENTS ARE IN THIS ACCOUNT?" Is this an account where payments you made have been deposited? Or an account you put money into, that CS payments are drawn on? Messing with CS in serious business. Depending on what actually happened, you may be able to sick the state DFS [or whatever agency is concerned with CS] on them.

Regardless, you say you are suppossed to leave the country in two weeks. In your place, I'd be calling attorneys first thing in the morning, because this may well take more than two weeks to straighten out.

On your employment... Do you work for an offshore company, or an offshore branch of a US company? If you're working for a foreign company, I'm a little mystified how a US collector was able to effect a garnishment.
