I keep getting threatening calls from these guys saying that they are going have a warrant put out for my arrest for a $150.00 loan that I paid over 200.00 for so I closed my account. Now they are also calling my 80 year old grandmother and terrifying her half to death with there threats.I say in my book that is harrasment. I don't know how to get them to stop I asked them once to leave her alone but they keep it up. I am ready to get legal help and give them a taste of there own medicine. Do you think thats a good idea or give me some advice on what to do?

ANy state law will say that they cannot threaten criminal action unless it really is a criminal action, which debts are merely civil. On those grounds, you should file complaints with your DFI, AG, and maybe even the FTC.

If your grandmother is not on the loan, they should't be telling her anything about your debt - that is a violation of the Graham-Leach-Bliley Act and probably state law too.

Just stand up to them when they call; tell them you know what they are doing is illegal and you won't tolerate it. And tell them if they don't stop they will be the ones on the chopping block.

I didnt know revealing info about a debt to a 3rd party was a GLBA (Gramm-Leach Bliley Act) infraction...I do a lot of information security work with a bank and outsourcers and understood that it applied as a data protection mandate for safeguarding stored non-public consumer data.

But to the poster, if it gets bad enough with your grandmother, call the police in addition to filing the complaints to the parties that DebtCruncher listed.

GLBA doesn't just pertain to records databases -- it governs all "non-public personal information" and any release thereof, which includes the fact that a debt exists and anything else about that account. The release of that information to anyone without a legitimate purpose does indeed violate the GLBA, as well as the consumer's right to financial privacy.

Heck, I'm sure PDLs don't give their customers a privacy notice anyway; so that in itself is against GLBA.

Shelly I know it may seem drastic but maybe you should consider changing your grandmothers phone number and maybe even your own. If you tell the telephone company you are getting harrassing phone calls they will not charge you. It makes me sick that these scumbags would harrass/terrify an elderly woman. I hate them and hope they all get banned.
