Is it legal for collectors to call even on Sunday.You would think they would give you some peace sometimes. Is there any laws that govern them at all. Are we just at their mercy?


I live in Ky. The debt is my sons,not mine.He used to live here so they keep calling here .It is really a pain especially when my children answer the phone and they ask for their brother and they say he is not her.They never tell them he isn't living here.They offered a settlement but he dpoes not have financial means to accept it. What is the statue of limitations?

You are NOT stuck. He doesnt live at your phone number and once the CA is told that, they have no business calling you again. Telling them that this is not his home or his phone number is not going to make them sue him any faster. Save yourself the frustration....tell them not to call again.

Patricia, then it is time to send them a "Cease and Desist" letter! You don't have to be constantly harassed by these people. Send it Certified Mail, Return Receipt Requested. Hold onto the receipt when you get it back, and if they call again then sue them. Even though you are a third party, you should still be able to sue them for violating the fdcpa.

What is the name of the CA? Does it show up in the caller ID, and if so what is the number listed? Were you able to get them to give you a mailing address when you asked for it? If not, you can probably find it on the Internet, or someone here can post it.

I think I said before how some CA's start treating third parties as "surrogate debtors"; calling them numerous times in a single day, after they have been told the debtor doesn't live there and not to call back again! What are they hoping to accomplish by this? Getting sued seems to be the only thing that might make them pay attention to what they are told!

Patricia, you didn't explain in your first post it was not your debt, send them a C&D. Do they give any information about the debt when they call when you tell them he doesn't live their?

I'd send the C&D CMRRR and add to it, "this is not my debt, this person does not live here and cannot be contacted xxx-xxx-xxxx, if you continue to call this number I will be forced to utilize any and all legal means to prevent this harassment.
