Recouping lawyers fees

I got served a summons from CACH on a SOL debt (about 7 years old, SOL is 4 years). If I can get the case dismissed do I have to file a separate lawsuit to recoup my lawyers fees.

I have them on violations anyways so if I have to file a separate lawsuit I can.


My attorney filed my answer with the court but I dont see anywhere about countersuing. She said that first we need to deal with the initial lawsuit then file suit on the violations. I guess that the lawyers fees will come into play on the follow-up lawsuit.

Thanks for your response, we are in the discovery phase so a countersuit is too late now I guess.

CACH seems to file lawsuits alot here, probably hoping for a default judgement. Im actually looking forward to see what they have to say in court since the debt has dropped off my CR and I know a payment has not been made in years.
