Being sued by Credit Card Company

Hi, my husband is being sued by a CitiCard. We live in Louisiana and they acquired a lawyer in our state and he was served with a suit. All of his credit card debt was turned over to Freedom debt relief in March of 2007 and they did not resolve this matter and now he has to file an answer to the complaint and we do not have the money to get a lawyer to help us with the answer. Can someone give me an example of what to do?


First of all, if you do not want to go to court...call the lawyer who is representing them and explain that you cannot pay the entire amount, but will work out a payment plan with them. I do not know how much you owe them...but if this is feasible do so. They will obtain a judgement and if you fall through on the payments, they can garnish your wages.
Other thing is to go to court and arrange a slow pay. You will have to provide info. on your household expenses and debts and the court will tell you how much you have to pay. I am thinking that you have to apprear in court...I would be prepared with the paperwork that you had from the debt settlement co.

We are more casualties from Freedom debt relief. They have collected money from us, about $4000. The CC Company is sueing us for $10,300. We have an income tax refund of $4800. So that's a total of $8800 that we could pay them, but apparently Freedom Debt "can't" negotiate with them to settle for this amount and now we are being sued so that my husband's wages will be garnished. I don't understand how they would not accept the money. It's only a $1500 difference! Is Freedom Debt even talking to the credit card companies on our behalf? I really feel cheated and lied too. Should my husband contact the cc lawyer himself and offer him the money? He's been told to let FD handle it, but they don't. He's been sued once before for another card and they did absolutely nothing for him in court. He had to go to court blindly with no legal representation and agree to what they wanted.

I was in the same boat with a different settlement company so I know what you are going through.

First, is this debt yours? If it is:

Here is what I did:
I called the lawyer myself. I did not have enough money to settle but they told me that I could settle at 50%. Since I did not have the money, the lawyers were very willing to set up a payment plan for me. Be prepared to pay interest on this.

I think it is so much better to set something up before it goes to court because if you are in a state that allows wages to be garnished :cry: they will probably get it. I did not rely on my debt settlement company to deal with this once I was served. I then contacted my settlement company and told them I wanted this debt taken off my account and demanded a refund since they were unable to get a settlement on it. When they wanted to give me only a percentage of my refund, I had to file a complaint. Then, they were more than happy to give me a refund.

This company is not the one that will have to go to court and they will not have their wages garnished, so I believe the best person to deal with this situation is yourself. You have the most to lose.

This is my husbands debt, not mine. My name was never on the account and I was never an authorizes user. He has really messed things up and I am not a happy camper. He won't take my advice and chooses to continue to work with Freedom Debt.

If Freedom Debt is actually working with the collection company, then it makes no sense why they won't settle.

Also, it's Pallasades Collection, which I've been reading about on this forum. Apparently they are aweful to deal with.

Received a summons today (4/15/10) on c/c debt of $1500; card issued while I lived in NV; however returned to Louisiana 4 years ago. I have extreme medical conditions, have not been able to secure a job in Louisiana at all and no income. My husband and I have been separated for 9 years; I live at his largesse in his home - absolutely nothing is in my name. What can I do about this debt? I cannot pay it, a portion of it and I have no assets at all -absolutely none. My car is 10 years old and in both my husbands and my name - it has no value.
