I realize from reading the forums that my best course of action is to either close my account or have the bank change it to credits only. My bank is Charter One and I spoke with someone at customer service who said that this is possible. I haven't gone to the bank yet. I wanted to post here first and find out which of these PDLs are licensed in my state.

The pdls that are not paid in full, you will want to work out payment arrangements with. But your account needs to be taken care of first so you money is safe.

However, that will not take effect until tomorrow and the way it was explained to me is that the PDLs transaction are already considered "in process". I should have gone to the bank yesterday because PDL fees are due to hit my old account tomorrow. The person at the bank was very helpful though. I told her I had sent out cease and desist letters already and she said that I could bring copies of the letters in and fill out a fraud complaint and that the bank might put the money back in my account. I believe she told me that this was up to the manager's discretion.
So at this point I do need to put the letters together. Should I back date them to earlier in the week? Just curious.
BTW, I requested my loan documents from a few of the PDL companies today and they did not supply me with my original loan document. For example, Payday2go sent me a loan document that stated I initiated the loan on 02/28/2008 when in fact I believe it was 12/18/2007. The same was true of Little Loan Shoppe.

Okay, km. Here's what you need to do real quick. Since the pdl debits are already pending, the bank is going to let them go through, correct? Just for the banks sake (and to get those debits reversed off your account so you're not overdrawn), type up a quick letter for each pdl. Short and sweet. We can work on the "real" ones later that you will actually mail to the pdls. This is just to give to the bank so that they will reverse the debits. Just type up a generic letter. Put the pdl name and address at the top (so all you have to change for each one is the pdl information). Then type " I hereby revoke debit authorization of any bank account that I may have by your company, your partners, and any affiliates." Type your name. Do one for each pdl. This is just a temporary letter. Back date it if you have to. These will just be for the bank. This way you will have letters to give them so they will take care of these unauthorized debits since they are already pending. Of course, we will "backtrack" and get the letters stating everything in detail for your pdls to receive.

Do you happen to know where I can find addresses and contact numbers for each of them? Even though they are just for the bank, I do want them to look like a letter. I do have loan documents for the majority of them but I'm not quite sure if their address is contained in those documents.
I believe I will also need to send letters to the Payroll/HR departments of both of my employers. I just want to cover all of my bases. Does anyone have a generic letter available?

I haven't been able to find a fax number for Payday Island anywhere and no one answers the phone when you call. All you get is a silly recording. I did call Instant Loans Now and Little Loan Shoppe and they gave me their fax numbers. I was able to locate the fax number for US Fast Cash in an email they sent me. I don't have them with me right now, but I will post them later when I get a chance.

So the PDLs have noticed that they didn't get to raid my bank account, but only one, B&L, contacted me about the faxed letter I sent to them. Payday Island was the only one I wasn't able to fax a letter to. I did send certified letter to each PDL except for my cash now, who is in Canada.

Avantis is correct that many merchants use SCAN but how many of don't have an ATM/debit card for our checking account these days? I can't remember the last time I wrote a check for a merchant. However, it is somewhat scary that they are using this as a threat. I do owe them on my loan which I am willing to pay but I'm just not willing to allow them to raid my bank account any longer!

I still need to send letters to my AG/Office of Financial and Insurance Services who regulate PDLs to file a complaint, BBB, and the Federal Trade Commission. Quick question, when you sent these letters, did you just send copies of the same letters you sent to the PDLs with a cover letter stating the reason for your complaint? If that's the case, all I need to do is type up a quick cover letter for the State of Michigan and file formal complaints electronically for the other two, which is time consuming but well worth it!

I just stated they were unlicensed/illegal, etc. Stated my dollar amounts and dates, etc. I didn't send them copies of the loan documents or anything. Just a "summary" of everything. This way I just typed one up, then just edited it to fit each pdl and printed them out. When you file with the BBB and the FTC, you can just file on line. They just want a brief description. So, it's pretty quick. Just have your facts straight and dollar amounts straight. The state AG, depending on what state you are in and how they do it, sometimes you can just file on line. Other times (as in my case), you download a complaint form and fill it out and mail it in. If they want more documentation, they will contact you and you can send it in.

It's really crappy that pdl's can report to places like this . . . . But at least nowdays most people use debit cards and not checks so they will never have a problem. And if you are writting checks to take advantage of the float time that is a bad habit anyways and something you shouldn't do . . . .

The reason it cracks me up is because the 'business conducted' was with a resident in Michigan and also through a bank account in Michigan. I mean, hello! Did you go to South Dakota? No. Is your bank account in South Dakota? No. So, in essence, they were 'conducting business' in Michigan. Well, at least in my eyes! :wink:
