what are the rules regarding wage garnishment? I did not get notice that Sturm, Horlick, & Israel out of Minnesota was going to begin garnishment. I thought I was to have a court hearing first. I had not notice that they were going to begin garnishment. This bill is for a Capital ONe acct.


I've been getting calls from a company "Creditors exchanged" regarding an account I had with Chase. They informed me that my wage will be garnished for nonpayment and I have to appear in court. I relocated to another state. Will I have to report back to Florida for court appearance?

Like Unclewulf sttated, they will need a civil judgment ordered by the court to begin garnishment for a creditor.

On the other hand, an Administartive garnishment does not require a court order. These are mainly for Student loans, Child support, Military debt, or any other federal debt you may have.

I would call Capitol One and see if they have a judgment pending against you. Best of Luck :P
