You can even phone them and record the conversation, get them admitting they don't have any validation, or better yet, that they don't have to provide it, then you have them in quite a spot if you took them to court,.

If you would take the time out and read what I first posted on this topic you would see why I want it validated. If the account is mine then I will pay it off. I just know that I am not putting money into something that I know is a scam or is a mix-up on someone else's end. I work hard for my money just like the next person. Stop trying to belittle people because this forum is a site of hope for people who want knowledge. What is so wrong with that? Aren't we as people supposed to grow? i never said you didnt have the right to do so.. 1st of all i never even said i was a debt collector! and btw im female.. i have read the whole forum.. as well as the letter you forged to asset.. it says no phone contact.. not anything about mail.. your contradicting yourself and need to be more clear about your wishes if you want anyone to help you.. i deal with collection companies on a daily basis and yes, was in your shoes at one time.. so no ones belittling anyone or "bulling' or what ever else you would like to cry wolf about..

I received my DV letter from Asset Acceptance and I am totally d
I received my DV letter from Asset Acceptance and I am totally disappointed. It only states the original creditor and original account, my name, the balance on the Asset account, my address, and my last 4 digits to my SSN. This is clearly a brief DV letter. I wanted one more detailed. Should I contact the original creditor myself to see if I can find some more info on it (i.e. transactions, open account date, where this card was used)? They clearly didnt take my letter seriously because after the validation they are still trying to collect payments on this account. I refuse until I see some more information. The balance is horrific. It is a whooping $7276.41. Thats a used car for me.

Lemme guess... It's something they printed up in-house, right? Maybe on their own letterhead? That doesn't make the grade for validation, my friend. Proper validation requires the collector to obtain documentation from the original creditor, then send it to you. See this FTC opinion letter for a good explanation. In your place, I wouldn't worry about contacting the OC, unless the OC is contacting you. Asset likely bought the account from the OC. The OC probably doesn't have anything on it anymore. If Asset could have gotten the info from the OC as required by law, they likely would have.
Document their continued collection activity carefully. Continuing to pursue collection activity without providing proper validation is an fdcpa violation. You can sue for that, BTW.

There are, indeed, some posts in this thread that should probably be deleted. (Hopefully, none of mine... ) But I would hope that the mods would find some manner of dealing with the problem other than by locking this thread. James seems to be benefitting from it. Which, after all, is the entire reason we're all here.

The Wollman FTC letter is the enclosure that goes with it. It's JCEMT's letter, so he obviously likes it. I've used it myself with good results, so I'm kind of fond of it as well.

They havent called or sent letters since then. How long should I wait until I send another letter to them stating for proper debt validation?

Thats the reason why I need Asset to validate it correctly. Like I posted earlier all of my credit card info was lost due to Hurricane Katrina. So I was using my credit report as a guide to see what I did and didnt owe. All Asset has to do is show me the signature of the credit card agreement or something stating that I actually used the card. I really dont remember having a Discover card. It was so long ago. This is my last credit account that I am dealing. I paid my debt off with all the other ones. Asset is my last one. The crazy part is that Asset still wants to collect money and cant validate my debt but Asset hasnt been on my credit report on any of the 3 bureaus for the past year. Thats kind of weird to me. I may just have to investigate this myself because if this account is not mine then I will go and file a police report. If the account is mine I will go ahead and pay it off. It is not a problem. I am not trying to get out of paying a debt. I just want to make sure that the debt is mine.

their has to be a legitamet reason they are collecting.. u said they sent you somewhat of a validation.. from what ive seen people that "steal" anothers identity dont pay the bill.. or they'll charge up the card and not pay it.. did it say what the last pay date was? or if you really want to get it taken care of tell them you want a significant discount (some 60-70% off)- large debt collection companies look at making money on the portfolio of accts they purchase not individual accts.. that way you are taking care of it but not at a huge expense.. (lawyer fees or P.I. fees ect.)
i suppose its how bad you want it off your credit report.. or in your case as well to be left alone.. i know how it is!!! just a few suggestions.. hope it may help..

I give up on trying to get proper validation on this account. I called Asset myself and tried to get some answers. They said they couldnt track the credit card usage. I am like thats BS. Its a credit card. Its traceable. First they started off saying we will help you. Then they got desperate and was asking me things like "Can you borrow the money from anyone? Can you take out a loan? Can you go into your 401k?" I am like WTF is going on. I just explained to you that I need you to investigate this and you are still trying to collect. I told them if the statements come back that I used them then I will pay but if they were used by someone else I am not paying. So they told me that they would have to request all of the credit card statements and that it would take 6 months to 12 months. They also told me that the account will continue to grow with interest. I am at a point right now where I just want to see some proof. The account is already over $7000 so if I have to pay that then oh well. As long as I have proof I dont care how much it is.

I HAVE THE GREEN CARD THAT I GOT BACK WHEN THEY RECEIVED MY DV LETTER AND THE LETTER RIGHT AFTER THEY TRIED TO COLLECT AGAIN. THIS OFFER LETTER HAS BEEN SENT TO ME AFTER I SPOKE WITH THEM OVER THE PHONE. THAT WAS WITH NO AVAIL. THEY SO MONEY HUNGRY OVER THERE AT ASSET. I AM THE TYPICAL AMERICAN CITIZEN. PEOPLE LIKE ME JUST DONT HAVE $2000 LET ALONE $7000 JUST LAYING AROUND. I KIND OF 50-50 ON JUST SAYING THE HELL WITH IT AND PAYING IT AND GOING ALL THE WAY TO FIGHT IT.
