OK, here is what you need to do. First, did you send those validation requests out by certified mail? If so, do you still have the receipt cards for them? I sure hope so, because they are about to get this lawsuit closed for you if you do.
Here is another important question--have you been served the summons for this case yet? If not, then you need to stay on top of this big-time, because they may be trying to get a default judgment against you by breaking the law. When you checked with the court, they should have had a docket available so you could see the activity that has taken place up to now. Check that docket every week, at the very least. You need to know if they have told the court that you have been served, ESPECIALLY if you have not been. This is a fairly common tactic used by CA's like this to try to get a judgment against you when they arent entitled to one.
If you are served, you will need to file an answer with the court within a certain number of days, or they will get a default judgment. We have been pretty successful in helping people in your situation get through this, so if you get served, please come back and tell us about it in this thread. We will help you answer it, and then list out your affirmative defense. As long as you sent those letters out by certified mail, and as long as you still have the green USPS cards that can prove the date they got that letter, then you will be in the clear. The thing is this--you have to be able to prove that they got your DV request in their hands before the date they filed this complaint with your court. Once you have that, your defense will be that the lawsuit itself is a direct violation of section 809 of the Fair Debt Collection Practices Act, and therefore should be immediately dismissed with prejudice. I can put together one hell of an affirmative defense statement for you on that. Just let me know if you are interested.

You can also re request DV through discovery, where they will have no choice but to provide it, or you can also have the suit dismissed that way as well.

I went through my papers and according to my records and the usps web site, LVNV funding attorneys received my certified letter requestion validation of the debt on February 13, 2008. After that I heard nothing from them or LVNV funding. I spoke to the court today and they told me they filed suit against me on February 28,2008. Fifteen days after I requested validation. I am guessing at this point that you havent actually received the summons? If not, then I would wait for it, since you will have to answer the summons either way. But, you need to keep an eye on the court clerk's office on this one---since they know you know enough about the law to ask for validation, they might try to sneak this case past you and get a default judgment without serving you. Dont worry, this is illegal. But you do need to watch for it, in case no summons gets to you. Here's what you do--keep checking every so often with the court clerk's office. Each time something new is added to the docket record for your case, you will be able to learn about it there. If they dont serve you, and them move for default judgment, it will show up on that record. Thats when you need to notify the court that they are out of line, on two counts.
If you get served, let me know, and we can put together your response to the summons. You will be making a motion for immediate dismissal with prejudice, due to their repeated inability to validate the debt, and also on the grounds that this lawsuit is a direct violation of section 809(b) of the Fair Debt Collection Practices Act.

I am thinking about talking to an attorney. I check weekly with the court clerks office and they have nothing documented in my case file. I am starting to freak out about going to court.

It has been proven that all those companies are in fact owned by Resurgent (and thus LVNV) There was a very nice posting about them somewhere..basically LVNV likes to try and pretend to be the OC so they can completely bypass the laws, but it didn't work in the case I looked at.
I challange everyone here who is being harassed by LVNV to look at your letters...I bet you will not fine ONE that is from LVNV themselves.....it is always from one of the other companions, such as Pinnacle, Weltman, etc. This is because if they were to send a letter, they would have to put the 30 day dispute disclaimer, thus ruining thier attempt to play OC. You will not find a collection letter from LVNV themselves.

Sorry, I gotta call Bullsh*t on this. I've talked to lots of people dealing with this, and the debts in question are almost always 'owned' by LVNV. Resurgennt is just another of their shell companies. Nice try.

Here's what I did: I got a call from those loveable folks at Resurgent. I interrogated them until they admitted that LVNV 'owned' the account in question. Then I DV'ed both Resurgent and LVNV about that account. It's been a couple of weeks or more. Dead silence.
