Cease and Desist Communication Letters - Do They Work?

What experiences have people had with the cease and desist letters they've sent to PDLs? Do they work, or do the PDLs ignore them and call you, your references on your applications, and your employers anyway?


stephenupchurch. . . .I don't know if it works with all of them. I sent them out to ameriloan, my cash now, Pay Day Max, Us Fast Cash and Star Advance. CPD called me twice at home and one of my references once before I settled it, which was just today. I settled with Ameriloan through the BBB and they never called anyone. Us Fast Cash and Star Advance have not contacted me and I don't think they have contacted anyone else either. I am sure that others can add their experiences as well but I will tell you this. There seems to be no rhyme or reason to anything they do. What they do to me can be totally different than what they do to you. It's a crap shoot I'm afraid.

Yes they do. I believe they "collect" for them when you default but my feeling is that they are all so intertwined that it's hard to tell just who is connected to who. They were pretty easy to work with though. Maybe I just got lucky and spoke with someone who had a guilt streak. Hang in there. With a little resolve and perseverance things will work out.

They've never worked for me with payday loan companies and collection agencies working for payday loan companies. If anything, they call more after you send them.

But I also want to point out that the Original Creditor (the actual company you have the debt with) has the right to call you. You can send them a cease and desist letter, but they can still legally call you. Only 3rd party collectors have to follow that. But the Original Creditor does have to stop calling you at work if that is requested.

Goudah - Can I get a clarification on something in your previous post? You said the C & D letters never worked for your with PDL's or their collection agencies. Then you said that they do have to stop calling your place of employment. Does that mean that the PDL's or their collection agencies still called you at work after you sent a C & D letter? Or, do you mean they still called you at home, on cell, or bother your references/relatives, but didn't call you at work. The calls at work are what I'm most concerned about. The calls to relatives would be second, but much lower priority than calls at work.

I also read something about C & D letters saying they are only legal when send them to 3rd parties (collection agencies, attorneys, etc.), not the orignal creditor. Is that true? I noticed you did say the original creditor does have to stop calling you at work.

A couple other things. Is there a cease and desist form letter somewhere I can print out? You said they didn't work for you with PDL's and their agencies. Can you tell me if you've had any experience with these PDL's as far as sending C & D letters? United Cash Loans, Impact Cash, Total Lending, Eastside Lenders, AIP?

Oh, and I will be filing complaints with the illegal companies with the Oregon Dept. of Banking as you advised (although I am dealing with some late rent issues this weekend which has taken on the HIGHEST priority since my landlord basically told me to get him the $$ by Sunday or they would file - I've got $30 more to go, but I don't know what the heck I'm going to live on until my nexy payday on 4/18) Good thing I put a stop on my direct deposit and closed that checking account. I'm eternally grateful to you for the advice, otherwise I'd be out on the street by this time next week. Thank You again. :D

brian. . .there is. It is usually right above your post but I noticed that you are posting as a "guest". If you register, I think that is where the edit function comes into play. As for the C and D letters, I sent them out and I was contacted on my my cash now loan and Pay Day Max loan but it was from CPD. Once I got the phone call I faxed a copy of both of those C and D letters over to CPD and the next phone call I got from them was telling me that My Cash Now was PIF and closed and I could PIF/close my Pay Day Max with the remaining balance of my original loan, which I did. I have been very fortunate as I closed/settled three of my PDL's in less than 2 months and I also have the help of living in New York State on my side. The other 2 are just a pain right now. Not answering my emails, asking for more than I have to pay. . just being a royal pain. I don't think about them until they surface and then I just tell them again they are illegal and you will get what I owe on the original amount when you send me a mailing address. Thanks a bunch. Have a nice day. My plan has been just to annoy them as much as they are annoying every other person in the world until I get a PIF from both of them. Good luck and keep at it.

How do I register? I filled out the short form - below where it says "what happens after I sgin up", and I got a call from Superior debt relief shortly thereafter. But I was never assigned a password or username and I've emailed Vikas and never got a response. I'm going to try Jason, but is there something I'm missing here? I'm clicking on where it is says "sign up". What are the Debtcc points? Because I have to manually log in as a guest every time, I don't accumulate them or does it keep track of my # of posts.

Brian....go to the top of the page and if you are not signed in as a guest, I think it will give you some options....sign in, contact us, privacy. It should also say sign up. Click there I think you should be golden. To be honest with you I don't remember just how I signed up but I think that is how it is done. Also, to answer your question, your points are not accumulating because you are not signed up. Once you are registered they will add up. Good luck. Keep me posted.

LLW - Thanks for the response, but that's what I was trying to say, that I used that sign up form but never got a password or username sent to my email, and that because of that, I'm not accumulating points because I can't login as a registered user. I emailed Vikas but go no response. I'm going to try Jason as someone suggested.

Brian...it was the tiny little logo with the padlock next to it not the box that requests your name, etc. on the right? I was sure that was what I used to sign up. I know that I filled in the info in the box on the right and that was when I realized it was for the debt relief program, not the forum.

Brian...once you click on the little sign up (with the padlock) at the top of the page it will bring you back to a sign up for the debt relief. If you go to the bottom of that page it has another flag for signing up with the community. Click on that and it should be you to the sign up for the forums. Try this.

llw - Thanks - wasn't looking low enough for the community sign up. But I'm still having problems. When I did that, it says there is already a user with my email address. So then I put my email address in the "lost your password?" box over on the right. It says, your password has been sent to your email address and I never get it. I've done that previously several times and I never get the email with my password. It's not going in a bulk mail folder either. So, thanks for the helo. But I'm still stuck at this point in time.
