I live in California and have 15 payday loans currently. I got into trouble at the beginning of the year and took out a couple to pay rent. then had to take out more to pay other bill and the interest fees, basically it has just snowballed into a nightmare. How do I get out from this? I was reading some of the forums about putting stop payments and revoking wage assignments and am just very scared and confused. My next payday is this Friday and I also need to pay rent this week. If anyone has any suggestions for my next/first step I would be eternally grateful.

okay, here is my 4th question on this page. I thought of it last night as I was going to sleep. I can't send the letters out today via certified cause I am overdrawn. If I send out most of the letters via email tonight, is it okay to wait until tomorrow to send out the hard copies? I am getting so scared, tomorrow is the day all of their debits are supposed to hit. I went to the bank yesterday and they said they put a hard block on the account. I keep thinking, what if it doesn't work? I think I will call this morning just to make sure it is really there!

Mom I have not sent out the letters either. Try to remember you have overpaid most of these so it is a technicality anyhow? Right. They cannot debit because of the hold and if you are overdrawn, they would not be able to anyway? Right?
Most of these will not know that your account is closed/on hold for several days as it is?

momof-Hi there!
Tried to get on last night, but fell asleep early.

Both of those paragraphs above look great! You are right on track. You can start emailing them and if you can, get them sent via Cert mail this weekend.

Keep checking your bank account for sure....I checked mine daily even after I was told not to worry.

Thanks for all of those addresses! That is all I need except for the 2 you are having trouble with. The thing I 'm worried about is even though I am overdrawn right now, my paycheck hits tomorrow and I don't want them to get anything. I have to pay my rent. But, I will just keep checking with the bank to make sure this cannot happen. I just keep thinking that so far the process of keeping them away from my money has been too easy and I am waiting for the other shoe to drop. It is hard to be optimistic, but I am trying. It is definitely much easier with all this support and help.

Okay, so I went back over what everyone is telling me to do and just want to clarify, Volleyballmom, that I should NOT send out any letter until my account is actually completely CLOSED? If so, good thing I went back through everything! Let me know when you have a chance please. Thanks again for all of your help!!! :) :) :)

Good morning momof-Yes...you are right on. It should be closed today right? :D

Heres why we recommend that...if the PDL's get a hint that you are closing your account, they will go in a debit everything the possibly can immediately. So if they get the letter and still have access to the account, they will bleed you dry.

Roxy-thanks for the address

Roxy, Thank you for the address. You have been such a help and support here! Volleyballmom, thanks also, yes I go close my account this morning. When I first got up this morning, I logged on and my email comes up automatically and there were emails from some of my PDL's saying that my installment had been processed. I freaked out! But then I just checked online and my paycheck was deposited and nothing was taken out!!!!!! What an amazing feeling to have my rent and grocery money! Thank you, Thank you, thank you to everyone one here!!!! :D

I had several payday loans a couple of years ago. Not anymore. Declared bankruptcy a couple of yrs. ago and those accts were done away with. Not advocating that you do the same. Follow the advice about getting control of your payroll check and bank acct first. The payday loans are a scam, and they provide more of a huge disservice to people than they do anything else. Once you get caught in the loop of "robbing Peter to pay Paul", it's hard to get out of it. These companies count on it...that is why the charge such enormous fees. They know that people are going to find themselves in dire straights needing money for any emergency that pops up. They make a profit off of other people's misery. Seems there is a lot of that going around.

Today I am getting my first phone calls, so far one from United Cash who I have way overpaid. So I am not so worried about that one. The second one was from E-Payday who I still owe about $210 on the original amount they lent to me. I sent out letters last night via Email to almost all of my companies E-Payday-Loan and United included. Both of the calls I have received have been at my work. I guess my question is that if I have requested that they not call me and correspond only via mail or email, do I have to talk to them? If not, what can I do? Just keep sending them emails?

Mom, No you do not have to talk to them. Yes, you just keep sending them e-mails. I would add a commentary and past in my pdl letter each time a company called. I would do that over and over. I wrote something like, I was contacted on (date) at (time) by (whomever left the message). I previously emailed, faxed and sent you a letter on (date). In that letter I specified I was not to be contacted and all communication would be in writing only. I will not communicated with (company name) otherwise. I have placed my original letter below outlining my instructions. ....or something like that and would e- mail it every time a company called. Sooner or later they will quit calling.

Mom, when you go to the bbb site, it will redirect you to the correct bbb when you type in the address. I know what you mean about the phone calls. After the first few treating me like dirt, I just started not to take calls alltogether. I do not deserve their abuse. Also, Paul makes a good point. Keep track and followup when you have time. It is also good to keep track so you can be really specific when you file your complaint. I did that too...I would put in my complaints that they called 23 times in one hour.

Thanks Roxy and Paul! I will do that. I also did what you suggested Roxy and sent them emails regarding their phone calls. I will continue to do that as it seems like a great way to log everything for my records. Great news, too! I received my first PIF letter from Paragon! I was surprised at how fast they responded.

Volleyballmom, I was just re- reading some previous posts and you said that you sent a letter to Cashnet USA to propose a payment arrangement? What did you say in this letter? I don't think I should send them the same letter as I sent the others since they are legal in CA and they are calling me. I would really prefer communicate with them only in written form. Let me know when you have a chance please. And thank you in advance for your help!!!!

HI momof-
I owed CashnetUSA $300 (loan for $255, fee of $45). Here is what I sent them. IRONICALLY...I didnt get around to paying them as I had proposed and they sent me a settlement offer of $150 to PIF.

I understand that I have an outstanding payday loan of $300 which includes the principal balance of $255, plus the $45 loan fee. At this time, I am proposing to pay CashnetUSA $150 on XXDATE and $150 on XXDATE via money order.

Once I inform you of this, you must stop the telephone contact immediately or you will be once again breaking the laws of the state of California.

You are also hereby notified that I am revoking any voluntary wage assignment I may or may not have signed. I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes.

I am revoking your right to debit my checking account any longer. You, your company, or your affiliates are not authorized to debit my checking account at all. Please be aware that I have informed my financial institution of this situation and they will also be receiving a copy of this correspondence. Any further attempts at debiting my account will be rejected by my financial institution.

I expect a response from your company no later than DATE regarding this matter. This response may only come via US Postal mail or email. No telephone contact is permitted.

Please respond by DATE, regarding this matter by US Postal mail or by email only.

Something weird is happening with this thread for me. Whenever I go to look at the last page of the thread it shows me as signed out and I can only see my last post from yesterday. I know Volleyballmom has since posted but I cannot see it. But if I go to page 6 of my thread it shows me as logged in. Should I start a new thread?

Thanks volleyballmom! I will get them to them via email first and then mail it!!!! Now another question for you or anyone that has an answer. I received a rather nasty email from E-Payday-Loan yesterday. It states that I am severely delinquent and I must call within 5 days from the date of the email to make payment arrangements. If I don't they will report me to several consumer credit reporting agencies. They say for example, Teletrack. Here is the question part. I have sent them a letter and an email. I do still owe them $210. My original loan was for $300 and to date have paid $90 in fees, so now what do I do? They seem to be ignoring my email and the letter has not gotten there yet.
