i had a credit card with Fleet, and they sold to another company and then sold again. i was so confused on where to send my payment, i didn't hear from them for along time. i got a letter saying they would settle for 1,330.00 whinh i was going to send. i got a summons from the court from Cach,LLC and they are wanting 8,000.00 now. they would not give me any info on who had owned my loan and all i want to do is pay off what i owe them and no more. i live in N.C. and i know laws are different. they are wanting me to sign and notorize a paper to pay 75.00 a month til i pay 8,000. what should i do, please help. i just want to pay what i owed fleet and be done with it.

Don????????t sign or agree to anything until you know if they own the debt. You must send the a letter requesting validation. There are some sample letters in the ???????Do it yourself??????? link above. Some one will be along soon to advise you. You came to the right place for help.

Evenin' Wanda -

First, contact the court to see whether they've actually filed a case against you, or if they've just sent you an immitation summons. Do this tomorrow morning, early. Court contact data should be on the summons. Lemme know what you find.

Second, do not, under any circumstances, sign that paper they sent you, promising to make payments. At least, not now. If you do, they'll be on you like a bad rash for the next several years.

Third, you need to demand validation of this debt. They need to be required to prove to you that their numbers are right and legal, and that they have the authority to collect this.. Send them a [customized] version of this letter in tomorrow's mail. Send it certified mail, return receipt requested [costs about five bucks], so you can prove they got it. And keep the little green postcard in a safe place when you get it back. That's your proof.

Fourth, how old is this debt? When was the last time you made a purchase or a payment on this account?

Fifth, let us know what you find out. We'll help you plan the next step.
