I normally don't even answer their calls but I get tired of hearing the phone ring. I have paid so much to these PDLs and almost lost my home so what she is threatening is almost comical. If they are legit why would they not have sent communication in the mail. She even asked for my address. There are so many holes in their stories. I have actually gotten educationally stronger from this forum on these guys and they are really lost as to what to say when you actually know what you are talking about. I don't know everything but I do know that you don't get a phone call telling you you're going to jail. Sorry to go on and on but I have had about enough from PDLs.

1. Violation of the Fair Credit Reporting Act-reporting inaccurate information
2. Violation of the Fair Debt Collection Practices Act-continuing collection activity on a debt which has not been validated
Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. However, just rest assured, they can do NOTHING to you, honey. They can NOT collect on this debt. Per our Department of Financial Institutions, this is not a legal debt. So, no, they will not be licensed to collect, no, this is not a legal debt, no, they can do $hit to you except try to harrass the living crap out of you. Honestly, motomom, that's all they can do is call you and give you idle threats. No need to be worried. Illegal debt - can not be collected in our state - period. Just watch out though. They might throw themselves on your credit reports, but you can dispute it and have it deleted. Otherwise, no worries.

Please if you are having problems with this firm. Contact the BBB. I did and they are not operating within the Law. They even went so far as to lie to the BBB when confronted with thier ILLEGAL collection practices. This guy Joshua called me and threatned to sue me for a credit card debt that belonged to my aduld child that was in college @ the time she got the cc. He had my ssn and everything.He had my new phone number that could not have been listed by my daughter 3yrs ago on the cc aplication because my # has changed. He was very specific in threating to sue me. When confronted by the BBB they straight LIED in the response. They sent a half-ass letter of apology through the BBB saying it must have been a misunderstanding. I understand when someone is dishonest and trying to use threats to collect money illeagally. My complaint will stay on file for 3yrs with the BBB. The best way to get them in line is to report them. They will not be able to keep this up if enough people report them.

I'm glad I found this site. I got a call from a Mr. Lopez asking for me to call him back. After looking them up I realize they must be calling for paydayloanyes.com where I took out a loan. I paid most of the loan back and then missed a payment. the next time my payment was due they took out 3 payments.. which should clear up the loan. They then said I owe another $140. When I asked for a verification of what was paid and etc. the guy got frustrated with me. Fortuanlly all contact with them was through email... but I plan on sending in a debt validation letter. Does anyone know their address?

My mother informed me last week and kind of hesitated to tell me beings I am in bad health about this law office calling..aftere reading about this firm through different sites I decided to email them today to ask what it is about and that I am on SSI living with my elderly mother helping her pay rent and I have nothing anyone can take away because I can't afford to buy anything of value. Am 62 years old with onset of osteoroporis and a gene disease which affects my spine and eyes, chronic angina and just found some other problem with my heart with it acting up when its resting. I cannot deal with stress or yelling or threatening.
I do not know if they will email me back but if not what do I do without having to deal with the stress of them yelling or threatening me.

I got a call from the Law office back in July. I looked the office up and I found this thread, so of course I didn't pay... But then... I got this SUMMONS! I cannot believe I have to appear for Arbitration on Oct 13, 2008!!!! Now they will not even talk to me about this debt. I knew I took out this Clout credit card 5 years ago when I was in College. I thought it would have dropped off by now... Can anyone give me any advise????? I should've paid them when they offered me too,,, Please anyone help!

Hi my name is Brent Hendley several months ago I had a debt that I finished paying off I did not get a receipt for this debt It was Bill Starks that wasthe one that had my account. I am sending you this now because he said that I had payed this debt off and I didnt need a receit. Well it was from Chase bank and guess what come other creditor is calling and sent me a letter saying I still owe money on this account. I think something is not right here Can you please let me know what happen with this. And if it is payed off send me a receipt.

I just wanted to chime in and give some perspective on these so
I just wanted to chime in and give some perspective on these so called "law firms" who are calling to collect debts. I'm a CPA, and thus required to have some knowledge in this area.
First of all, these "law firms" are not legal advocates or counsel for these payday loan outfits. They are collection agencies who are renting the name of a licensed attorney. Do not be bullied or scared into thinking that just because an attorney's office is calling you that there is a lawsuit pending or anything like that.
This is very dry stuff here people, but bear with me. The loans that you owe, and the past due fees and interest, are "ASSETS" that belong to the Payday Loan company. An asset can include cash, or in the case of loans, THE RIGHT TO RECEIVE CASH.
These "law firms" pay money, probably for pennies on the dollar, to these payday loan outfits in return for the right to receive YOUR cash. In other words, they buy assets from Payday Loan companies and aggressively attempt to collect the money from YOU. They profit because, even though they paid pennies on the dollar for the right to receive your cash, they charge YOU the original amount owed plus much more in fees and interest.
These illegal payday loan companies, knowing that they will never see the light of day in a court, would rather sell these toxic loans to outside shady collection agencies rather than waste their time trying to do in house collections.
This is a very shady web of userers, thieves, and scam artists. In my opinion, they're no better than pimps and drug dealers and they need to be confronted and shut down.

Another thing to add to my post. Now that we know who these people are, my advice is to not communicate with them at all. Send them cease & desist letters if you wish, but these scumbags will not honor them anyway. After all, they ARE operating outside of the law.
Ignore there calls to your cell phone, and have their calls to your workplace sent straight to your voicemail, and eventually they'll give up. They are ONLY attempting to make contact with you in order to bully you into making a payment, so what's the point in communicating with them at all?

They are driving me crazy. I need to know if this is true and what can I do I have prove that I have pay for a year already

Read the posts above. This "law firm" is a scam collection agency for the payday loan sharks. They are all bark and no bite. Send them a cease & desist letter, do not answer their calls, and if they keep harrassing you, file a complaint with the Better Business Bureau.

we have been receiving phone calls from this supposive company for two days now. The guy originally called saying he worked for the law firm looking for a person whom we don't even know that previously had our phone number. Then the guy kept calling from "private name private number" on our cell phone. He proceeded to tell me he had all of our personal information including my husbands mothers info. When i kept asking who it was hey kept telling me that he was our worst nightmare. We hung up on them. He continuosly kept calling us and each phone call began to get more life threatening. This man told me that he wanted $5000 or i could come over and "perform" for him. I told him i was a married woman and wouldnt do that and then he told me that he's sure i would if my husbands life was at stake. over and over he called and kept telling us he would never get tired of calling us. He told us that he worked at this supposive law firm and that he lived in orlando florida. The guy has repeatedly called threatening our safety and lives if we didnt give him the money. Its pretty bad when you have to go out and spend thousands of dollars on personal protection when you fear from your life due to a bill collector who has contacted the wrong person.

I don't normally comment on month-old posts, but I have to on this one...
Folks, there are shady collection practices. And then there are outright crimes. If you're getting collection calls containing:
- threats against your lives, safety, and/or property
- vulgar and/or obscene language
You're being threatened, as well as scammed. Deceptive, harassing, and/or abusive collection tactics are violations of FDCPA and assorted state laws. Those are actionable in civil court, and you can recover damages for their actions.
Threats and abuse such as I've highlighted in the quote above are all of that, and more. They are actually crimes under federal and most state laws. That means that the people spouting this crap can actually go to jail for it. But you've got to stand up for yourselves.
Record their calls, if that's legal in your state. File complaints with your telephone provider. They can get the authority to record calls for evidence in cases like this, regardless of whether you can legally record or not.
You also need to file complaints with these official agencies:
- your local and/or state police
- your state's Attorney General's office
- their state's Attorney General's office, if you know where they're located
- the Federal Trade Commission
- the Federal Communications Commission
These are government agencies, people, and they have the power to make life extremely unpleasant for the folks abusing you.
While you're at it, you should file reports with these unofficial groups/agencies/websites:
- the Better Business Bureau (BBB)
- ripoffreport.com
- budhibbs.com
- debtconsolidationcare.com (Start a thread in the appropriate forum here. We'll help you through reporting and filing complaints, etc., in addition to helping you deal with the collections issues involved.)
This is America, folks. Not Uganda or Stalinist Russia. You are not required to submit to this sort of mistreatment. Stand up and tell these criminals 'not only no, but hell no!'
