can I be counter-sued?

I am no legal eagle, but my guess is yes. I think anyone can file a lawsuit for any reason.

But common sense would tell someone not to file a lawsuit they are unlikely to win.

Sure they can counter sue but they will still need to prove their case. How much do they claim you owe them and how much are you suing for? My guess is that if they could validate that they would have but since your dragging them into court they might as well try to counter.

I got them for up to$6,000 in violations including treble damages. They say I owe them $860 which I don't. It has been 2 months since I sent a DV letter and they never validated.

So if they try to countersue, that would be continued collection activity, am I correct?

So let them file a counter claim. If you can prove just one violation then even in the very unlikely event that they prove their case you still win as you debt will be gone.

I don't even think their attorney has it anymore. He is a debt collector and a bad one at that. I haven't heard a peep in a while. I also tried to verify the collection agency he was going to sue for on my credit report and it got deleted in 15 days.

I am going to the court house probably next week to get the paper so I can file it in small claims.

time to report the troll again. do not listen to there stupidity.
