Pending Civil Suit PLEASE HELP - Capital Recovery Associates

Ok Capital Recovery Associates calls and calls, and the late time they said they would send my account tio an attorney in my area. They are in Niagra Falls New York and I am in Kansas. They are now calling regarding a pending civil suit, that I NEVER EVER got any paper work inthe mail about. They never sent anything in the mail but claim they have. THEY TALKED TO MY HUSBAND ABOUT MY CASE AND TOLD HIM WHAT I OWED AND MORE, and he already knows but is not not illegal. i only borrowed 190.00 bucks from payday max, and CRA is trying to get 492.00 out of me.
i never sent a cease and desist yet but i probably should but I bet they dont listen to it anyway.
What else can I do. I have not sent one red cent to these people casue they never want to take what I can afford and I am not paying 302.00 more than I owe.
anyone else deal with Capitol recovery Associates????


first, it isnt illegal for them to talk to your spouse the law allows that

second, if you signed any agreement on this pdl it allowed for interest and that seems to be what they are charging you, if thats the case it isnt illegal and you do owe it. how much have you paid on this loan already?

you also cant send them a dv letter now, well you can but its too late, if they really served you a summons you need to request validation through discovery in court

can i got to jail for unpayed payday loan they called and said if i cant pay them they are going to take legal action does anyone what kind of of legal they are talking about i cant pay the amount by the time they said so im going to jail
please help me IM SO WORRIED

I don't think a spouse counts as a third party. You should definitely DV them as was suggested above, plus you may also want to make sure that the PDL is licensed (if a lending license is required) and find out if the CA is licensed (if they require that of collectors). It will give you some ammunition to fight them with.

If there is a case already, make sure you get the validating documentation during the discovery phase.
