Someone will be along shortly to post your laws for your state. Hang in there we are here to help you out of this cycle. To tide you over until someone can get back to you, you are going to have to close your checking account and you need to read the thread on closing your checking account due to pdl's prior to doing so.

Others will be along to advise you further.

Goudah you are correct! I have searched these companies, and have not found any licenses on these IPDLs. They could be doing business under different names like ameriloan is a d/b/a of MTE which is still highly ILLEGAL

Cardskh, do not let these PDLs get another dime of your money. Most are way overpaid and owe you a serious refund. I would immediately put a hard block on all incoming debits on your bank account or close it completely if you can. Please read the following thread on closing bank accounts before you do so.

Okay I have one more question for you guys. Has anyone been free of these evil PDLS for a long time? Say over a year? The reason I am asking is because I have this fear that they will be lurking to try to garnish wages or something somewhere down the road. And thank you all again for the information and support. I feel better knowing I am not alone in falling into this trap!

Listen, PDLs cannot garnish your wages. Some ILLEGAL PDLs try to make you sign a Voluntary "Wage Assignment" at the beggining of your contract. Let me stress it is VOLUNTARY and can be revoked at anytime. Please type wage assignmnets in search box uptop for more info. There are many ppl here on this forum who have been PDL free for 1yr plus more. Government debts and IRS, things of that nature will proceed with garnishmnets. If you have an installment loan which is not a PDL, it is of a different nature, then they can sue you and place judgment against you to collect their debt. But these are only LEGAL LOAN companies. The internet PDLs you have listed are all ILLEGAL and cannot garnish your wages. I will tell you they will try and scare you into paying by verbal abuse over the phone and through emails that's it. They may even threaten you with the infamous "Download" scare. But it is all bogus! As long as you have paid what you borrowed and get your paid in full letter marked with them you will be fine. If they try to come back in the future with this nonsense they are SOL

Agreed. I copied every email I got from the PDLs that was connected to my PIFs and kept the receipts for any funds I sent to them. I have neatly packaged it away for future reference, should I need them. Please don't spend your precious time worrying about the what ifs of these guys. I have found that most of the stuff I could worry about never happens and if it does I deal with it as it comes my way. Life is way too short to give ANY more of your time to someone who doesn't deserve it. Good Luck. . .and try not to worry.

Actually, they could garnish your wages . . . . There are some pdl's out there that do try to sue people, and if the person doesn't respond they get a default judgement and can garnish. If the person does respond, the case is normally thrown out. Tremont is a great example of this.

Never say never with pdls . . . . . . There is almost always an exception.

No they have not tried to call my work. I have not missed a payment...YET.... but I'm sure here soon I will be hearing from them. Someone mentioned a C and D letter, what is that? Sorry to have so many questions. I just want to make sure I have my bases covered. I am planning on going into my bank on Monday to speak to them.

Okay, so I have read that some people have sent their letters by certified mail as well as via email. I can not find email addresses or addresses for the following:

247Advances.com
GRC Funding
B & L Marketing
Arrowhead

If anyone has any information on these it would be greatly appreciated.

Also, basically if any of these have charged me more than the allowable fee in the State of Indiana I do not owe them squat, right? I plan on sending the state law that Jen posted for me. My next payday is next Friday so I'm hoping to get this all settled with my bank on Monday to block the next round.

Roxy...thank you so much! You guys have been great. Next week is going to be hectic between speaking to the bank and sending out the emails but it will be worth it in the end. I just hope my bank works with me, if I have to deal with NSF charges on top of the PDLs it will be such a mess. I have banked with the same bank for 10 yrs now, I hope they will let me close this account and open another.

Card. . . glad to hear that you are moving forward with this. I have banked with my bank for years as well and they were so willing to help me out. We closed both my checking and savings and went ahead and reopened another checking. Thankfully, all my PDLs honored my revocation request (to the best of my knowledge) but the bank said they would not reopen the account for anything. They kept their word. I know how disparging this can be but rest assured things will get better. I know when I came here in February I was sick as a dog with the flu, it was the dead of winter, and my oil tank was getting pretty low. I really thought I was going to lose my mind worrying about how I would pull myself out of this mess. Thanks to all the great people on this board I found my sense of self again, in a relatively short time, and found the motivation to move past this. Just reading the posts, and having people respond to my plight took the entire weight of this hell off my shoulders. I told no one of this but the people on this board. With each passing accomplishment I became stronger, more agressive and felt that I could face any on them. I was no longer afraid of the what ifs. In just about 3 months, I had eliminated all 5 of my PDLs and my money and my life was mine again for the taking. Getting that last PIF, and it was a biggie, was cause for celebration. I had stated that I wanted to go into the summer months enjoying my free time and that I did! I know read the board several times a day and pitch in where I can. Until I see all these PDLs in hell, I will continue to be here on a regular basis. I have made some "long distance" "cyber based" friendships on here which have become part of my mainstay. Again, thanks to all and have a happy and safe 4th of July.

Roxy. . .my pleasure. I have never been known for my ability "to leave the scene of the crime" when I have accomplished what I set out to do. If I can help just one person, I will feel that all my efforts have meaning. I have always believed that I can return the favor by helping the next person out. Keep up the good work guys!

I didn't have a chance to go into my bank yesterday so I called customer service just to get a feel for what I would be told and the stupid girl on the phone told me that she thinks the best thing National City can do is to issue Stop Payments at $32 a piece. I said no, no, no I need an ACH Debit Block on my account and she said well you could let the charges come through and then dispute them with us, I said no, so I explained again and she said well I don't know that if you go into the branch they can do anything different. I am getting a little depressed at this point, I"m afraid my bank is not going to cooperate!

So you are not actually closing your account, is that correct?

If so, I agree with Shazz, go directly into the bank and fill out the affidavite that blocks the ACH authorization of the PDLs. You will need to list each one on the form. This will immediatly stop and reverse all charges from those PDLs. Make sure you speak with the BM

Well, I want to close the account eventually and reopen a new one, but I will have to have our direct deposits changed first before I do this so that is why I want the block set up. So I guess I should go through my last banking statement and use the names that the companies used when they debited the account last??

Yes you sould do that. The sooner you get to the bank the better. Make sure to list all names of PDLs on the form or forms. My bank processed it within 24 hours. If the PDL still gets through with their transaction, the bank will reverse the charges using the date you signed the form.

Now the big :!: CAUTION :!: is the PDLs can be tricky. They can attempt to debit your account under another name entirely. :? So it is best you get that new account set up ASAP. I suggest the block as a temporary solution.

I just left a message for the branch manager so I can discuss this with him and set up an appt. to come in tomorrow. I have read some other post that say National City is really hard to work with so I am really worried at this point that this is going to blow up in my face.

My branch manager froze my account over the phone, set up a new checking and savings account for us and is going to make sure my direct deposits are transferred to my new account on Friday. Yippee! Now I have to sit down tomorrow and send out my letters to the PDLs. I hope the rest goes this smoothly. Thanks for all your advice and support. I need to register here and I will keep coming back as well with updates and questions I am sure. This site is wonderful!!!

It's me again.... well my freeze didn't work because there was a valid pending debit that re-opened the account. The branch manager said that he is going to try to have the ACHs reversed while they are still pending which means by Monday I MIGHT have the money back since it has not officially been given to the PDLs yet. If he can't get it reversed then I will have to dispute them through loss prevention and I might not get my money for another 48 hrs. which sucks because I have bills to pay. Anyhow, I am pondering when to send the C and D letters and my ACH revokes out because of the account freeze not holding. I am wondering if I should wait until Monday to see if they can reverse them first without going through Loss prevention. Has anyone else had this happen? So far the bank is working with me, but it's a lot of red tape.

I would send the ACH Revokes out immediatly, so they won't try to make attempts to debit your account again. Especially since you are having problems with the freeze right now.
It's good to hear that the bank is working with you on this, a few people been going to battle with the bank and the PDL's.

Woo Hoo...I sent out my ACH revokes yesterday and got my first PIF from Impact Cash today. They first told me that they would settle for another $120. So I wrote back and said, my original loan was in the amount of $300 and I have paid you $90 every two weeks for the last 8 weeks, Indiana law states the most you can charge me is 13% or $39 a week interest and since I have paid over that it should have been applied to my principal. So I just got an email from Dan at Impact Cash telling me they will considered my account Paid in full...Yippee!!!
