Ryan, HELP National check cashers!

National check cashers has accepted 2 pmts from T & C. I know they don't have to "accept" proposals, however I've not heard from them in sometime and then today they call and say, "we don't take dmp" So I say, well you accepted the pmts and cashed them" she said, "well we won't refuse money, but this has to be paid now. I can take 4 pmts on your paydays, or ( OF COURSE), you can reborrow and pay that loan off in 4 payments." I said, "well I can't do that", so of course she said "well it might get sent to the attry and then we will garnish your wages and you will have court costs" So, we ended with "let me think about this and get back to you" I am right now at my max money point. I have to get my kids some school supplies and new shoes at least. So do we think this is a bluff, or what should I do? If they take me to court will it help if I show the DMP? Do you think the judge would still garnish?

Some will say since they are cashing the checks they agree to the re-payment. I forget the lady who called me but she was real nice to work with. I heard a million times that this was going to their atty. but never did. I don't think NCC would talk to T&C for me either. If they are cashing the checks, then I think everything is all good. As you are learning all these stores want you to reborrow. That is why I hope this law pass in Ohio. These stores act like people only borrow once or twice and thats it. Here they strong arm you into reborrowing again to keep you in this cycle of debt. That is why I was so happy to stumble accross this site. Gave me enough courage to tell them enough is enough. Whats the worse they can do if they take you to court? You have proof to a judge that you are trying to handle this. You know a judge will not lock you up in jail. And if you are paying T&C more than 25% of your wage then you know you are fine in garanishment. If they do win, they can only garanish your wage up to 25%.

Would the voluntary payments being made to T & C count towards the 25% of disposable earnings that could be garnished though?

It does seem to me that the judge would probably look at the situation though and know that you are trying to repay your debt and doing the best you can. I doubt that they will really take you to court as long as they are being paid. What would be the point? They are probably just trying to scare you into paying it off sooner.
