I would call T and C and let them know what is happening. You hired T and C and paying for their services so let them handle it.

T & C did call them, whoever they talked to told them they would call them back??? Never called back. T & C said they had not idea what they were "calling back for" ???

Sounds like a break down in the communications. T and C called and left a message with the PDL? And the PDL never called back? T and C doesn't know why the PDL is calling back, or the PDL doesn't know why T and C is calling back?

no T & C doesn't know why the PDL needed to call them back. The PDL would not talk to them at the time they called I guess.

Some will say since they are cashing the checks they agree to the re-payment. I forget the lady who called me but she was real nice to work with. I heard a million times that this was going to their atty. but never did. I don't think NCC would talk to T&C for me either. If they are cashing the checks, then I think everything is all good. As you are learning all these stores want you to reborrow. That is why I hope this law pass in Ohio. These stores act like people only borrow once or twice and thats it. Here they strong arm you into reborrowing again to keep you in this cycle of debt. That is why I was so happy to stumble accross this site. Gave me enough courage to tell them enough is enough. Whats the worse they can do if they take you to court? You have proof to a judge that you are trying to handle this. You know a judge will not lock you up in jail. And if you are paying T&C more than 25% of your wage then you know you are fine in garanishment. If they do win, they can only garanish your wage up to 25%.

Would the voluntary payments being made to T & C count towards the 25% of disposable earnings that could be garnished though?
It does seem to me that the judge would probably look at the situation though and know that you are trying to repay your debt and doing the best you can. I doubt that they will really take you to court as long as they are being paid. What would be the point? They are probably just trying to scare you into paying it off sooner.

I don't know if it would count or not. I guess I should of re-worded it better but hopefully a judge would see 25% of your income going to repay these bills.

I really doubt if a judge is going to rule to have your wages garnished if you are already making payments to them, AND they are accepting them.

That's what I think too. I think it would look pretty silly on their part to even take you to court over it.

Thanks guys!! That's what my husband says too..There is not much I can do about it right now, like I say we are maxed for the moment, with school starting soon. I guess I'll just ride it out and see what happens.
