It's a long story on the judgment but I was in the hospital and have lots of medical problems right now. The attorney for LVNV Funding said I never responded and got a default. I appealed and tried to show the judge the post office cards that I sent it but he called me a liar and denied it. So now I have to go back again for the payment hearing.
I plan on filing chapter 7 before the end of the year anyway so I don't know what they think they can get out of me. I am not going to pay these crooked lawyers almost $4,000 on a debt that was originally $1,800. They tacked on legal and court fees too. I asked if it was legal and the judge said it didn't matter. I asked for proof they own the debt and I never got it even though the stupid lawyer said he would be more than happy to show me proof which was all bs.

They don;t seem to care if you are on SS. My motherinlaw was sued twice, and they got a judgement on one and dismissed without prejudice on the other. As far as I know they have not requested a payment hearing. I would bring all the info to the hearing, and hopefully you don't have the same judge. He had noright calling you a liar. That is unprofessional. Appeal to the judge with the info - they cannot garnish your social security, but I am sure they will try to guilt you into payment arrangements. Could your bankruptcy atty advice you on this?

Yeah I know they have no remorse for people, it is really sad. They will not get me into paying anything and I will not sign anything. As for the bankruptcy attorney I haven't talked to him in a while, I was waiting till I had money to file which will be in November.
I have other debt collectors after me too but right now I just send a DV letter the second I get anything from them and so far none have bothered to reply.
judgements
i have went to court and showed up for both days, thought i was getting a regular agreement plan, when the papers were sent it said judgement for the plaintiff,at the moment did not understand that word, so i send in 100.00 a month moneyorder of course. the creditor is lvnvfunding but the payment are being sent in N.H lvnvfunding is in S.C i live in Mass. i put in a moneyorder inquiry from postoffice and see where are they getting cashed. if it does not look right im going to seek leagal help.
