I have sent my letters out regarding C &D and regarding ACH revocations. My bank has been really good an closed my account and have rejected any ACH attempts since that closure (I Love my credit union). But they have continually called my cell phone (I have not answered thanks to caller ID), I have received calls at work, from Web pay day, 500 fast cash, and my cash now, nh cash. How do I get them to stop? I have sent the letter below to all of them again today via email.

[quote]After doing research on internet payday loan laws in the State of New York, I have found that your internet payday loans are actually illegal. I have also found the following laws to be true applying to payday loans in the State of New York in general:
Citation:
Licensed lender law applies but interest rate is that agreed to by contract. N.Y. Banking Law § 340 et seq. A check casher licensee cannot make loans nor cash or advance any moneys on a post dated check unless it is a payroll check. N.Y. Banking Law § 373. Criminal law sets the usury cap at 25%. N.Y. Penal Code § 190.40.
Small Loan Rate Cap
25% per year
After finding out that your internet payday loans are illegal, your company should actually not issue loans to New York residents at all.
I demand that you mark my account Paid in Full.
I demand that any contact be made through US Postal mail or email only. I will need everything in writing to keep accurate records of all communication as per instruction from my Attorney General's Office.
I prohibit you or your affiliates to contact me via telephone at my place of employment or my home telephone number. I also prohibit you from calling my references listed on my loan.
You are also hereby notified that I am revoking any voluntary wage assignment I may or may not have signed. I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes.
I am revoking your right to debit my checking account any longer. You, your company, or your affiliates are not authorized to debit my checking account at all. Please be aware that I have informed my financial institution of this situation and they will also be receiving a copy of this correspondence. Any further attempts at debiting my account will be rejected by my financial institution.
I must also inform you that I have filed complaints with the Better Business Bureau, the Federal Trade Commission, and the New York Attorney General's Office.
I expect a response from your company no later than 5 days from the date of this letter, regarding this matter. This response may only come via US Postal mail or email. No telephone contact is permitted.
Please respond by regarding this matter by US Postal mail or by email only.
Sincerely,

unfortunately it may be a little while before the calls stop...do the calls at work go directly to you or do they go through a switch board? If they are going to a receptionist or co-worker you can have them tell the people you no longer work there...

Looks like you're on the right track! Good for you! As far as the phone calls, there really isn't anyway to stop them but I do have a suggestion. You could go to your wireless service provider and ask them to change your phone number due to harassing calls. At your place of employment, if you could somehow get the message to them when they call that you are no longer employed there?? I wouldn't speak with them when they call, I would just hang up, they will tire of talking to thin air after awhile and cease the calls. You do need to report this to your Attorney Generals office, you can easily fill out a complaint online, just be sure to include the harassing phone calls!
NY Payday Loan Problems
I used the letter above and sent to the seven companies I got myself into trouble with. My bank was awesome too. They actually reversed some of the charges for me.
I drafted up 7 complaints to the Attorney General's Office with my supporting documentation (74 pages in total). Haven't sent them to the AG yet, but received a call from one of the companies today at work. She was actually threatening me on the phone, at which point I laughed. She kept asking me if I was laughing and I kept asking her if there was a point to her call. I explained to her about the documentation, that they weren't allowed to contact me at work, and I wasn't going to get into it with her while I was at work. At this point she had the balls to tell me I might want to inform my employer... and I hung up. She had me so mad I was yelling and my co-worker had to come over.
Isn't this against the law? How can she get away with this?
