My husband received a call at his work from, supposedly a law firm by the name of Rosen and Loeb and the woman who called said they are getting ready to file a judgement agains us for our Washington Mutual card. Well, today we received a letter from the same person and it is a collection letter but the name of the company is North American Collectors, Inc. and nowhere on this letter does it say they are a law firm. They even refer to themselves as a collection agency. I am slightly confused now. How do we know if they are just a lying and deceitful CA or really a law firm? I am requesting a DV letter because this was just transferred from Arrow financial. Anybody have any thoughts on this? In the meantime, we did a debt consolidation and all of our other accounts have accepted the proposal so far but them because the account was just turned over. I really just want to know who these people are.

When was the last time you paid on the account? What state do you live in? Is this reporting and if so how? Arrow is a Debt Buyer and NAC is likely cllecting for them. A CA has no standing to file suit but the owner of the debt, Arrow or Wamu could retain an attorney to file in your state. Since you have received the dunning letter, make sure you send them a DV letter CMRRR w/in the 30 day time frame. I would add at the bottom that all calls to your home or cell are recorded since form their initial communication, they are threatening you with judgements. Fortunately, they must first file and serve before they can do anything else.

We hadn't paid on this for about 15 months because we were in a debt settlement program but chickened out and went with a debt consolidation program instead where we just made our first payment. NACI had not received the proposal yet because the debt had just been sent to them from Arrow but it was sent as of last Friday. What does Rosen and Loeb have to do with this though when nowhere on the letter that was sent was there a reference to them? We live in Oklahoma and NACI/Rosen & Loeb are in California.

You are still w/in SOL on this account so are open to be sued. Rosen and Loeb are California attorneys and doubtful that they are licensed to practice in OK. That does not rule out the possibility of Arrow or WaMu of retaining an attorney licensed in your state. How is this reporting? Does WaMu's tradeline show a $0 balance with a sold transferred notation?

I do not know what you mean by how is it reporting. The letter only showed that Wamu was the original creditor, what the balance is, and what the interest is. I know we are within the SOL...Iam just trying to figure out why the telephone call was supposedly from Rosen and Loeb but the letter was from NACI which is a collection agency. Same address, same person's name on the letter as the one who called and her title is "Account Rep". I just can't figure out where the attorney's names come into the pic.
