Date: Tue, 10/14/2008 - 12:30
The PLS Loan Store in IL is threating to send the wage assignment to my employer to garnish my wages even though I called to negoitiate a payment plan. They told me that it ain't no guarantee that they will not send it before I get a chance to come in to make arrangements. Please note that I'm not trying to get out of paying them this is a debt that I owe, but I need more time and more payment options flexibility and they won't give. Please Help me someone!
Wage Garnishment= Court ordered, employer must comply in garnish
Wage Garnishment= Court ordered, employer must comply in garnishment states.
Wage Assignment=Voluntary, not court ordered and can be revoked at any time. Certain stipulations must be met in order for a wage assignment to even be "legal". Example, in most states, if you are married, your spouse must also sign the wage assignment when it is originally executed.
Call your state dept of labor and get more info in writing for your payroll dept. Also, show your payroll dept that you revoked it with the pay day lender!!
The laws vary from state to state, make sure you check that.
