My wife received a call from a CA wanted to settle a BofA cc debt from 2002. It was charged off in 2003. She is disabled and will never be able to work again. She does receive SS. I have read that since she is over 40 and disabled, he chances of being sued are slim. Is this true? Also I think the SOL is beyond it date for Florida.
Any thoughts?


If they call again, tell them they have 5 days to send you details of the account. When you recieve it, respond to it w/in 30 days with a request for debt validation. If they continue to attempt collections before validation is provided then send them a full cease comm letter. SOL has expired but they can continue to report for 7.5 years from the date of first default. You have no legal obligation to repay this debt. If you do choose to pay it, then only do so if they will agree in writing for full deletion.
