I don't see how a company can help you get out of garnishment since those are court ordered (I think)...

I know, but they say if it's even gotten that far, with their package, it would prove to the judge that you only X amount of disposable income. Here's an excerpt from their FAQ:
Why does the Financial Hardship Package work - 1. You have documented proof you can only pay a certain amount based on disposable income. 2. You have documented proof that you have a legitimate financial hardship. 3. Typically creditors will not move forward with legal actions after a professional Hardship Package has been presented. 4. If the matter goes to or is in the courts, you will have a formal Financial Hardship Package that will confirm your efforts to re-pay or dispute any debt without the need for legal actions. 5. The package is a specific alternative to filing Bankruptcy, which most courts would like to help you avoid.
What if I never dealt with a debt default before - If you're not sure you can do this yourself, think again. The instructions included with the Financial Hardship Packages are so detailed, you cannot make a mistake. The package will give you confidence because it provides the financial tools to resolve any debt default.

Hmmm...I'm not sold on it...sooo many questions. I'm always skeptical because it's so easy to get screwed when you're already in a tough spot looking for some help. When something sounds too good to be true...you know the rest.
Tell me about it. That's why I'm asking. I'm already in a jam
Tell me about it. That's why I'm asking. I'm already in a jam and don't need to be in a pickle on top of it. It doesn't mix :) Ok that was corny.
Thanks for your response. I appreciate it. I was thinking about a bankruptcy lawyer, ***** ******* ****** in particular, but haven't heard too many good things about his firm. It's kind of difficult to do anything when all your funds are frozen.
I guess I could create my own financial hardship package and present it to the judge. The collection atty for the creditor said that there was no guarantee that the judge would take everything in the account. I wonder what it's based on.

You're welcome :)
I think you mentioned from previous posts...you have a court date on 11/5? That gives you some time to really think this through. If it's possible, talk to an attorney who defends this kind of case for the public. He may be able to let you know specifically the kind of package you could put together for yourself (pay stubs, etc., receipts of monthly bills) so that when the time comes ~ you'll have more of an idea of what you're walking in to :)

That's a good suggestion. Thank you.
The atty for the creditor also mentioned that they were simultaneously setting up a wage garnishment. Couldn't that be some sort of defense for my husband and I? I mean most creditors only take it that far. As their guaranteed to get at least 15% per paycheck. However, they decided to really screw us and freeze our account.

A garnishment would require a court order as well...so I don't think that'll happen before the date you're going in.

credit card debt
what if you do not do anything? Will the credit card companys really file law suit?

Some will, some won't. Depends on a lot of different factors... Age of debt, amount, type of creditor, your situation [liklihood that they could recover], and more.
As to that website, it didn't look so much. They seem to be selling boilerplate kits for credit repair and suchlike. With a very few exceptions, like child support [which we don't deal with here], there's nothing they can sell you a kit for that we can't help you do for free. It's your twenty bucks, do with it as you will.
problem with Debt Solvency Group
I would be concerned with anyone who for 19.99 says they can tell you how to solve your debt problems.
I tried to order their stuff but then realized that their credit card payment page is not even secure meaning all of your cc data is going to be transmitted throughout the internet. Not a sign of a professional organization and certainly dangerous for your cc information to be passing freely through the internet.
So while I cant speak for the legitimacy of their information, I can say they dont appear to be a true professional debt counseling organization.
Site owners please rebut my assessment.
