I received a summons today. This is for an old, old debt and I am trying to verify when the last payment was made. I tried working out a payment plan with them and settle the amount when they first tried contacting me but they were very rude and not willing to work with me. There are 2 pages to the summons, the first is for a court date in Chicago the other has a date of Nov 28th and was apparently a suit filed against me in Georgia. I have no idea what that is. I have sent a letter asking them to prove the debt. I am not sure what else I should be doing, I do believe the debt is past the 5 years which is the sol here in Illinois.

As an aside, I have been unemployed since March, which I explained to them when I tried to work out a settlement. My last check is due in two weeks then I have no income. I cannot afford a lawyer and this is for a debt they claim is 1500 dollars. I couldn't pay it at this point even if I wanted to at this time.


Look at your credit report to see when the last payment was made. Check with the county clerk to verify that the summons is real; if it is make sure you show up in court to avoid a judgement by default; also check with the clerk of the court in GA to see when a judgement was ordered against you. If you weren't served properly, you can ask the court to have this judgement vacated.

what county are you in?check the clerk for that court and see if there is a case.if not check the information on the document.you can still probably get it vacated for improper venue if it isn't in your county or town of residence.yes i am in illinois.posted too late,okay your in dekalb county.what did the letter say where is the court date supposed to be?

wait a minute,you are in lake county right?then show up and get it vacated for improper venue.this court date should take place in lake county not cook.

yes,but does your summons say the circuit court in daley center?

that is the circiut court of cook county.show up and have it dismissed due to improper venue.it could be without prejudice,but it should be dismissed for now.

Make sure you search teh IL Rules of Civil Procedure to make sure that your Motion to Dismiss is in the correct form that is acceptable to the court. Most courts will grant a little lattitude to Pro Se defendants but it also gives the impreesion to the Plaintiff that the consumer is well informed. That tells them that they may have an uphill battle.

I got a summons for a debt from Blatt, Hasenmiller, *, and *. I googled how to beat a lawsuit. I did what he said. I also bought a sample pack of how to beat a lawsuit, so i had an example of how to write the documents. I filed and answer with the court and sent a copy to BHLM. I sent a valadation letter to B,H,L & M. and I signed a sworn denial letter and had it notorized, also sent to BHLM. I showed for the pretrial, and it was dismissed, he said he didnt have enough to pursue it.
