Now I am very CONFUSED....

Okay I sent out a DV letter to RJM Acquisitions yesterday certified, but I know that they haven't recvd my DV letter since it was yesterday. I rcvd something today in the mail from MRS associates and this is what it states:

PREV CREDITOR: Wachovia
CREDITOR: RJM ACQUSISTIONS
CREDITOR ACCT# XXXXXXXX
MRS ACCT# XXXXXXX
AMOUNT DUE: 798.00

Than it says that these are my options;

1 - 35% off so I would pay one payment of 519.01

2 - 30% off so I would pay one payment of 558.93

3 - 25% off so I would pay two payments of 299.43

4 - Monthly payment plan on full bal.

Now the catcher is - let me quote from the letter " When you call please let your rep. knnow that you have rcvd the RJM ACQUSISITIONS option letter"

**** So who is the heck is MRS and how do they come into play???? Is this even possible??? Should I call or should I wait and see how they respond to my DV letter??? My DV letter was sent to RJM not MRS.

MRS is a collection agency based in New Jersey. Bad news, as far as not following the law. But they can be dealt with, just like any other abusive CA. You have the particulars of the account in question. Send MRS a DV letter in tomorrow morning's mail. They'll likely fade into the woodwork, and you'll be hassled by a new agency.

I'd be not at all surprised to find that at the bottom of this is LVNV Funding or somebody equally slimy, as the actual owner of the account. They farm things out to different CAs, then when you send a DV to that CA, they pull it back and send it somewhere else. That's their dodge so they don't have to validate.

You've already DV'ed RJM, and now you've got MRS after you. That leads me to think that RJM doesn't actually own the account. If MRS or RJM happen to call, ask them who actually owns it. They may slip up and tell you. Or, try calling Wachovia. They should be able to say who they sold it to.

They aren't supposed to be able to. One of the things that DV should tell you, is who actually owns the debt, and who has authority to collect on it.

You've already DV'ed RJM. If you've got the green card back in the mail, dispute it with the CRAs. That should get the tradeline removed, at least for now. When you get the green card back from MRS, do the same thing. Then keep an eye on your report.
