SOL question?

In being sued by CC,if the date of last payment on the account was 12-19-2005 and a claim for suit filed 11-21-2008, was served papers on 12-02-2008, and the case won't even go to arbitration/court until Jan.01, 2009 or later, will the SOL apply to the Nov filing date or by court date itself?Will I be able to say this account is past SOL based on date we go to court cause by then it will be past 12-19-2007 so past the 3 year SOL or does the filing date count being that they still filed within the 3 years whether it was 3-4 weeks prior to expiring or not?
