Anyone willing to share their story if you went to court/arbitration against attorney for CC? What happened, what is the process? I got my summons and will fight the attorney but I am scared to death!! I also have no idea what to do now, I know answer the summons but what does that mean? My case if mandatory non-binding arbitration. What happens? Do you go into a courtroom full of people? Is it just you and the plantiff and mediator? What about when non-binding arbitration does NOT work out and you GO to court, what happens? Anyone care to share your story?

I haven't been yet, but answered the summons and trying to work something out w/o going. The slimeballs sent a letter stating I had not tried working with them or contacting them and have now stated that I have 7 days to respond etc...I am almost at the point to tell the slime to go for it, because I for one am sick of all the stress. I have documentation of letters and phone calls that I will gladly send them as proof. I am getting ready to mail a Certified Letter to them today.

char62,how did you answer the summons?I am right now trying to find information to help me with answering my summons.

To any one else who knows, when you go to court is it like a small court room with just me,the plantiff, and judge or are there other people in court room like on Judge Judy?

it's not that bad. I had never been to court until a few months ago and was almost sick to my stomach over it. The court in my county, large metro area, had a lot of people in the courtroom and some were talking to their attorneys and some were talking to the clerk, etc... It seemed like there was a lot going on in the one room. The judge called cases up one at a time and you couldn't hear what was going on. From what I could tell, there were very few attorneys even in the room. Most of the people in the room were, excuse the judgements, dirty and smelly and really just poor looking. I felt overdressed in my suit jacket and tie. The plaintiffs attorney in my case was a locally hired guy who was working a stack of files the day I was there. My attorney told me that is common in collections cases and she sometimes hires herself out to do just that. I wouldn't be afraid of anything, just tell the truth and only answer the questions, don't offer any more information.
