I kicked Arrow Finacial $%# today in court, I WIN!!!!

I had my bench trial today with arrow financial services who were represented by Blatt, Hasenmiller, Liebsker and Moore. They hired a local attorney for all of the 3 dates I went because I am not in the Chicago area. The OC was Washington Mutual. They called every day demanding money and I was about to pay them until i stumbled on to this site and got advise from you smart people. I stayed up practically all night mounting my defense and when I showed up, the lawyer said they didn't send him any paperwork. He wanted to dismiss without prejudice. I said, "not a chance, i didn't get off work for this, it is either with predujice, or we proceed to the courtroom". He said o.k and judge stamped my form and I was gone. All those phone calls and letters and hiring a local attorney and they didn't even send paperwork.
Arrow is interested in 1 thing and that is settling, if you stick to your guns, they will give up. They sued for $2100 and sent me a paper the day before trial with a settlement offer of half of that. That is when I knew I had them.
I do have a question though if anyone knows. I know I can now get this off of my credit report, but what about the OC. How do I get the original off of there?

That is great to hear. They were probably hoping that you were going to be a no show and the would win the default.

The OC will remain for 7 1/2 years and then drop off.

How long has this debt been in default?

You can challenge the entry but I don't know under what cause.

DO NOT loose the court papers because more than likely they will sell the debt off and you will be contacted again.

Good for you!!!!!!!!!!! :lol: Sure sounded like a wonderful victory. In a case like this, wouldn't the OC come off the CR, too?

PDL's: 1000payday and Little loan Shoppe. I have a CA letter for 1000payday.......the CA 'handeling' this account reported it to the CB, on my CR. I DID default on this PDL. Little Loan Shoppe.....'defaulted' on this one, too. Not on my CR, however. On the 1000payday one, am I obligated to pay JUST what I barrowed and not all the % that is attached to the loan? Can I do the same with Little Loan Shoppe?

My defense was going to be that they didn't have any evidence. I sent a request for a production of documents and they didn't respond. These companies are just bullies and without sites like this, people wouldn't be informed of their options. I just can't believe it is even legal! I will not dispute the debt with the OC to see what happens.

they "say they are suing you"?? did they serve you with a summons yet? if you have not received a summons, then this could just be a threat designed to scare you into paying. here's the thing--federal law makes it illegal for them to tell you that they are going to take any action unless they actually intend to do it. So, if you have no summons and no court case has been filed in the next couple months, you can then turn around and sue THEM for violating the fdcpa....

check with the court clerk's office in your county. they will be able to tell you if anyone has filed suit against you. It is important to keep checking that every so often because a lot of these debt collectors try to sneak judgments past people by knowingly serving them at a wrong or old address--if you dont actually know about being sued, you wont be there in court to contest it, and no matter if they can prove their case or not they would win a judgment at that point. thats what many of them hope for.

my son defaulted on a car loan I co-signed. Wells fargo holds the note now Arrow financial has it. I've been summoned for admission of fact. Are they legiminate??? Can they do this. hat would my recourse be?????? I waill pay my 1/2 my son had better pay the other 1/2. PLease help I live in jefferson parish, la

I'm having the same problem. Arrow Financial holds my debt for my former HSBC credit card account and are suing me for $1400 plus attorney's fees, etc. Complete waste of time for that amount of money. I don't have the money to file the answer--not working right now and won't get paid for my new contract job until the end of the month. Not sure what to do about it. Any advice? I live in Mesa, Arizona, being sued in Maricopa County Superior Court, in the Justice Court, Phoenix branch.

Not sure if your reply was to my post or the previous woman's, matheny. I will show up at court, but won't have the money to file an answer. I am filing bankruptcy, hopefully in September. I have a number of other debts that I have tried to pay off but when I was out of work, it threw everything into chaos on that. I feel like the best thing for me is to do that.
