Hey guys, I need some advice. My dad keeps getting call from Resurgent Capital Services, LP about some past debt that he paid for. We called them to tell them that we paid for the debt we owe to old navy in 2007, but they insisted he didn't. We checked the bank statement and there was an authorize transfer to old navy. They said that is not a valid proof/evidence and that we needed the original receipt from 2007, but my dad threw that receipt away long time ago. So my dad told them we are not going to settle and told them not to call back. But they do. So we call them back, trying to deal with it cause my dad credits went bad cause of this. They are really ****about talking: an agent said "if you are not settling, there is no need to call." Wtf. So what should I do? If your wondering why I'm involve cause my dad is chinese and doesn't understand english that well. Thanks

first welcome,second two things.

1)it is up to them to prove you owe this.not you to prove you don't.
2)dispute the entry to the credit bureau's.

if you do a search in the bar at top right you will find out what you need to know about this bottomfeeder CA.what number shows pn his caller id?that would help in getting an address to send the DV and C&D letters.

BS that the bank statement is not proof, it is plenty of proof. As it is, that company is seriously violating your father's rights. Have your dad call Old Navy and see what they say the status of the account is. If they do have it listed as paid, have them send you something to that effect that you can use. Also, you need to send the company a debt validation letter, certified mail, return receipt. In this letter you again state that this bill is in fact paid and that they are not only illegally collecting, but that they have put fraudulent information on the credit reports. Have a copy of the statement showing the payment to Old Navy and black out any sensitive information such as an account number. Use a pen to circle the debit in case these bozos can't see it. In form them that you are giving them 30 days to close out that account and to remove it from the credit reports, otherwise you will take the matter up with your local small claims court and let a judge deal with it.

If you get the letter from Old Navy showing the account closed in good standing or with a zero balance, immediately make copies of it and sent that along as well to Resurgent, CMRR. If they fail to remove it from the credit reports or continue to attempt collections, take them to court.
