I received a letter which I was cc'd on from Mann Bracken which states that they have enclosed documents for the document hearing and the only thing they included was past billing statements. I had previously asked them to validate the debt which they have not thus far. Is the past billing statements a validation of debt?

If you have not been served a summons at that point, I would be checking with your county court clerk's office ASAP. Sorry if you were already aware of a lawsuit, I dont know if you have posted anything on this before or not. if it is just statements, then I would not consider that to be proper validation because anyone can make up a statement on a computer showing whatever they would want it to show. Plus, the FTC has offered its opinion on proper validation and they have concluded that the law does require that validation come from the original creditor, for the purpose of protecting the consumer from false claims.

forgive me if you covered this already, but did you ask for validation before or after they filed suit?
