I got the email AFTER I came back from the post office (sent certified DV/C&D letters to both the Blanding address and the Pine Villa address). I sent one letter to 1919 Blanding Blvd., Suite 4, Jax. I hope it gets directed to them!
They keep calling me at work today, threatening (veiled of course) arrest. Rachael Anderson called me at 8:45am at work after trying my cell, was instantly surly and threatening. She said she would email me a letter verifying that they are in charge of collecting the PDL debt, and gave me contact info to phone her after receiving the email.
Then about 1/2 hour later an unannounced man asked for the owner or controller, and hung up as I tried to tell him that I am the controller.
The email came finally at 1:07pm, and Rachael Anderson called me at the office at 1:10pm, rudely asking why I did not call in arrangements to pay this debt today by 1:00pm. She then put me on hold, a grumpy man came on, I explained that I was on hold for Rachael Anderson, he then put me back on hold. I needed to hang up because the other business lines were ringing and I'm on the clock.
A few minutes after this, a man (who didn't announce himself again) said, "Ms. Moore?", I said yes and then he started asking why I'm refusing to acknowledge to Ms. Anderson that I owe this debt. I told him that I was not acknowledging anything until I have the time to research this, and I started reading off the FDCPA lingo that is written at the bottom of their emailed letter that states that I have 30 days to respond etc. I also told him, "by the way, I just got back from the post office because I mailed a DV/C&D letter to you guys." I then asked him if he was not allowing me my legal right through the FDCPA, then he asked if ("123 Blah Blah Street") was correct (my work address). I then tried to tell him that threatening arrest is against the FDCPA, but he hung up before I could get it out.
Complete BOTTOM FEEDERS! I wonder how many times I'll hear from them until they receive my certified DV/C&D letter, and if they are going to harrass my mother and sister (they were my two PDL references).

Great website!! Yes, I recieved a call from them and I have noticed a few people making comments about paying your bills. Which is understandable and I dont think that anyone is complaining about that at all. Things happen in this economy, however the law is the law. They are breaking it, I have a payday loan out and I reached out to my original debt person. They advised me that i can go to any of their payday locations to make a payment. Dont let these people scare you!! Please dont let these people scare you!!! Check the Fair Debt Collection Act Practices and go from there. Just because you owe a debt, doesnt make you a monster. Things happen. As far as calling your employer the FDCAP explains that violation in great detail also.

I called them and let them know that they are violating the Fair Debtors Act, and that any further contact with me or my family will result in charges being brought against them with the Florida Atty. Another lady from my work said her husband got a call that he owed money and he better pay or else, then she got a check in the mail with a letter and he told her to deposit it and call him after the deposit, she did then he proceeded to tell her to send that money back to him a, but it would cost $150 to send it back , her bank had since then told her the check was fake. please everyone beware of h@p capital and dont send them anything . I have had the same problem with this company. The called me this past Friday telling me I had a filing..yada yada yada. I called the number back, the extension they gave me didn't even work. They looke up my phone and addess and couldn't find crap on me. Then they wanted my social..I said NOPE!!!!!If they are collecting for an online payday loan company they are full of shit because I have never filed for one online. I had one two years ago that was paid in full with a legit company. And one thing, a payday loan requires a checking account, if you fail to pay they take it out of your account. So I'm not sure what they hell this company would collect on. Anyways, I have checked my credit and found nothing that has gone in to collection. I will also be investing in life lock.

I told them I knew the FDCPA and that pissed them off. They told me to pawn my belongings or have my mother get a pay day loan because he would have his money by 1pm or I would go to jail. It is 3:29 and no cops here and the SOB didn't get a dime from me! In my state it is illegal to persue legal action for a credit card debt over 3 years old and BTW, I paid it off in April of 2006. Jokes on them!!! lol They tried to charge me over 700 dollars. My credit card limit wasn't even that high!!!!

I thought i was the only one..this is the first collection agency i've dealt with that were VERY RUDE!!!Here i am trying to exlain my situation being that i juss recently lost my job and was on unemployment..the representative ext 130 was yelling on phone saying that i was lying and was juss full of excuses...I told her to lower her voice then to be quiet..she then hung up on me...about half an hour later she called me back and tryed to scare me naming the king county court and what not...i then told her off that for a 200.00 bal how could i possibly go to jail for n it hasn't been a month nor was i contacted for this balance ever...again as i was talking she kept saying i was a liar n i couldn't take it anymore so i hung up...I was patiently trying to work a payment arrangement coz who would want to ruin their credits?? but she was juss too rude n was very agruementative...anyway, i'm doing some research about these folks i will pursue further if possible n if continue to be harrassing to customers...because of 10yrs in customer service we never treat customers like this...their's no way people would want to pay back or cooperate if this is how they treat their customers...

See the thing is you dont have to know the fair debt collection laws to do collections. 90% of the times they are just thrown on the phone handed a list of debtors and let loose. Result unfair practice. I cannot stress record the cnvrstion enough. They cannot say the threats did not happen if it's recorded. As far as you telling them not to call. How do they know they havent called a buissness line? All a debt collectors job is is to just inform the debtor that a debt is owed (per phone call, letter. etc. etc) So if they contact you they have informedyou of such correct? So if you say hey dont call me any more on this number do you really need to be specific and give them reason to not contact on that line? NO cause they have already informed you of debt with there company correct? So from that point on wouldnt contact by that means be considered harassment? Cause obviously the phone caslls on that line are an inconvieniance to you in one way or another (work line or not) Sowhat would the means be to call that number besides to annoy you enough to hope you will pay the debt. a) You have sent them a Cease Comm letter and they continue to call after receipt or
b) they have received a timely DV request and have not validated the debt. A timely DV would be one that was sent w/in 30 days of receiving the initial dunning letter. They have no time limit to respond but must cease all collection efforts until validation is provided.
Verbal cease comms are not binding, recorded or not, unless they are calls to your employer and it places your employment in jeopardy. Read Sec 809 of the FDCPA

Worst case here in Michigan its a misdemeanor for check fraud under $1000 (if its even determined to be fraud to begin with) so check your state laws. this company is so bogus. i am a refrence for someone and they keep calling me over and over. i work for a colection co and know they can not do this, it is illegal to call refrences over and over. i have told them i gave my brother the mesg and thats all i can do. they call my phone leaving explicit mesgs for him. i have talked to my brother who has tried to get in contact with them. they will not return his call, yet they leave me mesages stating he has 24 hours to pay or go to jail. they can not make him go to jail they are nothing but a bunch of liarers who try and use scare tactis to make people pay.

I too got a phone call today, they made threats to my daughter about me. when i called them back, a dan farrah i explained my situation he said let me find out if we can let you make payments he put me on hold a man came on the phone and told me that i had til 1:00 pm to make the debt right. i tried to talk with him he got rude and hung up on me. i was shocked. i tried to call back and to my amazement the same man picked up recognized my voice and said there was no discussion needed, and hung up again. i called ace cash express where i got the pdl, and they gave me the number to cooperate i spoke with a manager over there she put me on hold came back and told me to call a man by the name of tim hoffman, and he would take care of the problem. when i spoke with him i informed him that the man had said that i was going to jail if i did not pay by 1:00 pm he then asked what icould afford to pay that would be reasonable i explainedto him that i was unemployed that was the reason why i had not paid. i told him i could not do it today i have no one to ask for the money. anyway he told me to come up with something and call him back tomorrow, he would give me the info. where to send it. so when i got off the phone i got on the internet and looked up the laws for pdl. i then found the website for www.flofr.com i called the phone number and he advised me to not even call him back, and to file a complaint on line. which i did. do you believe i am doing the right thing by not addressing this matter. yes i do owe the money, i am not denying that, but right now my rent and lights are more important.

The fact the collector threatened you with jail only strengthens that probability as it is illegal for them to make such threats. Don't call them back. If they call you tell them they have 5 days by law to send you a letter regarding the debt. If you get such a letter then you send a debt validation letter demanding proof you owe them.
Tell them you refuse to speak with them on the phone and hang up on THEM.

You can record phone conversations without letting them know. You also have some good consumer laws being in Texas, you can send them a debt validation letter and they HAVE to do it in 30 days. Check and see if the debt is on your credit reports because if they don't validate in 30 days they HAVE to remove it from the reports.
Also in Texas collectors MUST have a bond. I checked and there is no listing for them, so they can't even attempt collections with you.

Help! I paid H&P a settlement amount 2 months ago, only to find out that they did not note my account as settled, and sent the remaining balance to another collection agency! They lied and said the woman who handled it before was fired, but I got her VM! I don't know who to call for my legal rights, or who to file a complaint with...or even who to contact to settle this with, because they were rude and condescending (even though they were the ones who messed up), yelled at me and wouldn't answer my question of who is the owner, address, etc. Now what do I do??

To whom it may concern; (all of us to the matter) My lawyer told me that you can not be put in jail just because you owe someone money $$$ !!!!!!! Debt collectors are violating our rights. Do not send any one a damn cent ! It's a scare tactic they are using and the verbal abuse from them is a BIG NO NO!!! Don't fall victim to their BS! But be ware you can go to jail for a STATE or FED Debt now they don't play- sorry. Also, a BONDSMEN can put you in jail (a person who post bail for you to get out of jail). There are plenty of sources you can complain to and possibly sue these assholes if you got the time- do some research or your homework.

He also gave the time limit thing, but an hour after the time limit he's still calling me for money. They said I owed 1120.00 but I told them I paid down to 840 already. Then they said I could pay the 840 but I had until the end of the day to pay it. I asked them could they send me something via email that stated once I paid the 840, everything would be over and done with. She said yes. Then I said could I pay a portion, she said I could pay 420 on monday and 420 by the end of the month. I said ok. then she called back and said suppossily the systems were down and she could not send me an email until monday. I told her I would send the payment once I get the email. I work in law enforcement so I will get to the bottom of this legally when I get to work because I think this is bull.

Do NOT pay them one dang penny! Tell them to send you a letter, through regular mail, that they are in fact required by law to send this letter within 5 days of first contact and that you will be requiring them to validate the debt.
If they try to say you already admitted to the debt you tell them you were confused and scared because of the illegal jail threat and felt intimidated to say what they wanted to hear.

Due to the fact that I closed my bank account before they could try and take any money out, they said that it was considered bad check or theft by check. Because the amount was over 500. I told them that I never wrote a check but they told me that due to the fact that I closed the account out before finishing my payments, it was like writing a bad check. My son is epileptic and I had to pay for medicine and co payments for his neurologist. They didnt even care.

I just got a call this afternoon some guy saying there were allegations brought against me and they didnt want to see me blind sighted by them...and it was imparative that I call them back, but never gave me any information about what the matter was concerning. Generally people do try to pay debts but when something happens that is uncontrollable like your baby dies during birth, or loose a home to a tornado , and now I lost home to a flood, lets see if you whine. there is a right way to do things and a wrong way, they do not have to be discord toward anyone like they were to my sister, when the guy accused her of being an ass like I was, I am a christian and when my sister told me what they said i was appalled. She had to threaten them with law suit. I am paying what I can. It might not be much. i have already paid $800 past what I borrowed and they still want 500 more. come on. Maybe you have a lot of money or you work for the company and are trying to disquise yourself. You need to know the proper way to talk to others:cool:

I realized that I screwed up, but there should be a law about the way they talk to people. I am very frustrated because I have no money to pay right now. I just lost my home to a flood. Dont have clothes and I have 5 children. I went and got several outfits a piece today for them, and i am grateful, its hard enough to get through another tragedy, i feel bad enough. But in illinois, they can file, and a judge can order you to pay but it is a debt, a loan, they cant put you in jail. I did write a check when you originally got loan but they tore it up and were using my number. I had always paid, until I lost my baby girl when I had her prematurely, right after that a tornado tore up my trailer park and it flooded. Now We had to leave the new place because its underwater. but there is one thing I have learned through this, I have a god that will be there for me. i can only do so much so no one worry. Also if you get any kind of disability, child support SSI or anything like that, that cannot be legally touched at all. State law
