Please Help - Online PDL's are sucking me dry

I'm seeing examples of letters for other states where the Online lending is illegal, but I am in search of a draft letter where the lender is not licensed in Arizona and the fact that by law, only 1 loan at a time, and that there is a limit on the interest rate.

Not sure what to put in the email/letter about revoking my ACH debits and wanting them to close my account with them as paid in full and getting any refund if due.

I have the following loans that seem to me from what I've already read on this forum, that they are not legal, what should I do from this point. It is too late to cancel the ACH that is supposed to come out on the 30th, and I am making a visit to my bank on 2/2 to close or put an ACH/hard debit lock on the account until I can open a new one.

Think Cash and CashNetUSA are both legit companies, you will need to make payment arrangements with them, but unfortunately you will need close your account in order to stop the debits, just call the legit companies and tell them your account is now closed and the only venue you have to make payments is through USPS by money orders, you aren't obligated to tell them why you closed out your account, that's your business. Hang on and I will try to locate information on your illegal lenders, then we can plan a course of action for you. :)

Are they allowed to do business in Arizona? I couldn't find an Arizona license on them.

You probably won't find a license for them because they don't operate as a pdl, they are either CSO's (Credit Service Organizations) or installment type loan companies, which means they are are operating legitimately and within the law. Sorry.

Is there a form letter geared towards Arizona laws that you could help me draft to cancel my ACH and ask for a refund? I am finding a lot of form letters for other states, but not sure what to say exactly.

Follow the steps below, there is a sample letter in it, just change the wording around a little, it should suffice. :)
You are only obligated to pay back the principal amount you borrowed from an unlicensed/illegal Internet Payday Lender.

Keep in mind that you may not receive a response for days, or even weeks, or, you may receive harassing and threatening phone calls. I have found the best way to deal with this is not to respond or reply, simply hang up.

Side note: If you have paid an illegal/unlicensed payday lender above and beyond the principal amount you borrowed, it might be a good idea to demand a refund and a paid in full letter/receipt. After doing research regarding Internet payday loan laws in the State of _______, I have found that your Internet payday loans are actually illegal. I have also found the following laws to be true applying to payday loans in the State of _____ in general:

Thank you so much for all of your help and advise, I will work these up and get these out as soon as possible.

I am able to afford the drafts coming out this Friday, but after that would have gone into default on them or incurred NSF fees at my bank.

You have given me a light at the end of the tunnel. Just wish I would have found this website sooner.

I am also from AZ. This is how cashnet is liecensed in AZ, if you check your loan docs you will see what I am talking about.

I have 2 loans that look as if they are licensed in AZ and I took them both out online. Since Arizona only allows one at a time, and I was not aware of that before this forum and knowing the laws in Arziona, what course of action do I have to request an EPP or paid in full since they are in violoation?

They may say you are in violation since you are the only one who knew you had two. Legal lenders in AZ are not linked at this point in time, thats why they ask on all apps if you have any other outstanding loans. Personally I would not try using that approach for your legal lenders and please keep in mind Think Cas h(First Bank of Delaware) is not a pdl it is an installment loan so pdl laws do not apply.

I am not trying to rain on your parade as I am in the same situation as you. Cashnet will do an EPP and you should call and try to get on the plan. I have not been able to work anything out with Think Cash as far as reducing interest or anyhing like that but my loan is current with them and I plan on keeping it that way. As I payoff other pdl's I will apply extra money to TC to pay them off.

Checkngo is a CFSA member and they are required to put you on the plan if you ask. You must ask the day before you are scheduled to go in to make your payment. Go in person ask for the plan if they refuse (they did this to me) call their Corporate Office and file compaints with CFSA. I did all of this and "WAHLA" I am on the plan. Also, when you go in and ask for the plan do not give them any money, you actually get to skip the payment due the next day and they schedule your first EPP for your next payday its kind of like a breather. Get on the phone ASAP if they do not comply. Like I said I just went through all of this with them. If need be let me know how is goes I have a personal contact for the AZ Operations Director who helped me.

Does anyone have information about this company and license in AZ? I am struggling to get them to stop attempting to debit or calling me after a cease letter (two times) I have even taped from their horrible messages on my answering machine.

I have reported them and now don't know what to do...they are really persistant and rude.
