I received my certified mail green card back from SPD Financial yesterday so at least I know that it was received. I logged into their website to view my account and it says it is in collections and I owe $390. I already paid them $1,170 and in the letter I sent them I requested a PIF and a refund of $870. I live in NC where PDL's are illegal but what happens if this loan goes to a third party CA. What can they do to me? I've alreay paid above and beyond what I owe. Can sending a pdl to a CA affect my credit, not that it's good anyway right now, but I definitely don't want anything added to it.

If it is sent to collections, the chances are the CA they choose will not be operating legally. You will probably receive a call informing you they are a CA, in that case you can tell them that they only have 5 days to send you a written notice that they are collection per the FDCPA (Fair Debt Collection Practices Act), look it up it will explain your rights.

Anyway, IF they do send you a letter (called a dunning letter), you will then have the right to request they validate your debt. The buck usually stops right there because I am highly doubtful they will be able to validate the debt, and during the validation period all collection attempts must stop.

Just google FDCPA, you can read about it at this forum also, type FDCPA into the search box located in the upper right hand corner of this forum to learn more about it.

You probably can't reach them. Close your account asap and dispute it with the branch manager. Your account will never be safe now that they have your account information.
