I live in Iowa and have 2 outstanding loans 1 through Ameriloan and the other through BIG INT. I received a call from a law firm saying they are charging me with bank fraud and other charges and they represent Cash Net. I never took a loan out with Cash Net. 1. Are they legal in Iowa 2. are they able to press criminal charges. I closed my account along time ago and haven't heard anything from the two that I owe. I paid more than my balance to the ones that I owe. Please help this really is making me scared


Hi viscott,

1) Make them prove it to you in writing. If you didn't take the loan, you owe nothing. Don't give them your address or anything, though. It's probably a scam pretending to be affiliated with CashNet.

2) Inform them that they are misrepresenting the law - they cannot charge you with bank fraud or any other criminal charges.

3) File a complaint with the FTC.

4) File a complaint with your State Attorney General.

5) File a complaint with the BBB.

If you know that you do not owe, don't worry at all. Don't speak with them, and file complaints every single time they call.

sorry,but there is more than one CASHNET.there is CASHNET USA then there is CASHNET500 aka PAYDAYLOANYES.i'm guessing this was CASHNET500.they are starting to claim they are CASHNETUSA,but they wouldn't hire cretins to collect.they can and will take legal action.

exactly my friend.that is why i'm sying this is CASHNET500.not CASHNETUSA.they wouldn't lend where ipdl's are illegal.

CashNetUSA sells a lot of its debt and some of it goes to a pretty nasty group of companies operating out of the Buffalo, NY area. The buyer doesn't say he's calling from "ABC Collections" - he says he's from CashNet itself to trick yuou into thinking the FDCPA doesn't apply. Since it's a sale, rather than a placement, CashNet gets to play Pontius Pilate and hold up it's clean hands whenever someone complains to the FTC or the AG.

why would they do that when they can take you to court for the full amount?i think you are thinking of CASHNET500.

Cost-Benefit analysis, Paul. Why would a CA in North Tonawanda, NY - that isn't licensed to collect debts in New York, let alone Iowa - hire a lawyer in Iowa, and potential have to send an employee to appear as a witness, when it can pay people $8 an hour to hound people into paying? Especially when they buy a lot of other debt that isn't legal like CashNetUSA's.
