A few weeks ago I received a letter from ACA Recovery stating that I owe $755.00 for a $300 loan that I took out with Ten Dollar Payday. I paid $90 on the loan before closing my account. I sent a certified letter to Ten Dollar Payday as well as emails and faxes stating that I am willing to pay the remaining $210 that I owe them. They never contacted me but turned it over to ACA Recovery. I sent ACA recovery a debt validation letter and in the mail today I received a copy of my online contract with Ten Dollar Payday, with my electronic "I Agree" signature. They sent nothing else with that paperwork. Does that validate the debt that ACA is charging me? What should I do about this?

Hi alinewcombe,

I had a collection agency do the same thing to me, they sent a copy of my contract & highlighted some info. Lucky for my they weren't licensed to collect in my state. I would first check to see if ACA is licensed to collect in your state. Is Tendollarpayday licensed in your state? If not, then chances are the collection agency isn't licensed either.

I live in NC so nobody is licensed in my state. I offered to make payment arrangements through Ten Dollar Payday but they never contacted me. ACA says I owe them $755. I'm willing to pay the $210 but that is it!! They know this too but are not willing to accept this amount, they want the $755. My AG says to only pay what I owe and if they won't accept that amount then that's their problem. I just hope they don't continue to hound me. I think I am going to sent this company another letter stating that if they want the $210 let me know and I will send them a money order and if not then it's best they leave me alone. I live in a state where payday loans are prohibited and they know this.

Send 10 dollar payday a letter stating their illegal status. Send same one to CA. Demand both companies provide documentation legal to conduct business in your state. Then ball is in their court. You should pay principle owed. Don't send any money until you get agreement from BOTH companies in writing(email OK) that principle satisfies debt, give you a PIF and cease all further collection attempts. Then once get agreement, send money order return reciept.

ten dollar payday is a d/b/a of MTE.therefore neither they or ACA will be legal.just keep sending your e-mails and they will get the hint.
