I am just doing research on how to deal with Sears or LVNV, the collection agency they sold it to. Could you give me any ideas on how to deal with them or why you find them difficult to deal with. Sears scares me. They are absolutely crazy about getting paid back. So I guess LVNV must be aggressive. Help- need advice.

I just negotiated my Capital one card for 1/2 the bill. The rep was really nice and I hope I talk to her again someday! I negotiated settlements for both my husband and I. I paid 50% of my charged off card and I paid 60 of his charged off bill. I talked with the rep for a while and asked her some questions related to rumours I heard. Like, if I pay with my debit card you may seize money out of my account? She said no. I asked her whether after the agreement and payment, Cap One will turn around and try to collect the rest of the payment? She said no. I really asked her straight up all kinds of questions. She answered all in a postive manner. In the end I decided to pay the cards off through Western Union ($12.95 ea). I called her back with a transfer # from Cap One and she verified that the funds were received and that was in one day. She faxed me the confirmation that I had paid, the next day.


congrats on settling capital one! i settled with them, too (but i do not western union anyone), isn't it great to pay off a debt?
LVNV.. i am dealing with one of their companies. I send out a debt validation and they keep dissapearing and selling me to one of their other companies. :/
i would send a debt validation letter because i do not trust them one bit! they are pretty agressive and kinda scare me, too.

Hold off on the C&D to LVNV/Resurgent. They will take that as a full cease comm and if you're still w/in SOL, they will file suit. Simply state in your DV that "All calls to my employer place my employment in jeopardy" and "All calls to my home or cell phone are recorded". That will also serve as notification if you are a 2-party recording state.

nah it was one of their other ones. nothing showed up on my report yet, actually (I just checked yesterday..). I only knew they were connected to LVNV through this board.
how will i know if they are to sue me? do i just need to wait for a summons? or will they bounce me to another ca? (some said they tend to bounce you from one to another?) either way i just want to be prepared..

sadly i work for the county as it would come through my office, which is what freaks me out the most :'(
yes, i still am in SOL but it's only for like $600. It's for HSBC, i would have paid but HSBC was being kind of shady and i was not sure how they even got that amount (plus i didn't have enough to pay it at the moment)

for less than a $1000.00. I had two small capital one cards $500.00 each limit and lost income and could not make the payments. (I had to pay rent etc..) Well needless to say, they turned them over to a debt collecting attorney and both cards are up to almost $800.00 apiece. I have not heard from them in awhile so I am in limbo. I sent DV letters and I am now trying to get annuity money to pay these people off. The stress is almost too much for me to shoulder anymore. I have two other cards who were sold off and some of the bottomfeeders mentioned on this board has them.

thanks to both of you for advice, I do not know for a fact if they are connected, (i hope they are not as LVNV scares me!)
i feel kind of bad cutting into this thread so i am going to "bump" up my old thread, maybe you could offer advice? (btw, frog - did you get any warning of this? or did they just sue you out of nowhere?)
