Has anyone ever heard of Hunt & Henriques? They bought the loan I owe, and have been harrassing & threatening to take me to court....Anyone?

Hi yaz bri,

Welcome to the Community!

Here are a couple of threads about them:
http://www.debtconsolidationcare.com/collection-agencies/huntandhenriques.html
http://www.debtconsolidationcare.com/settlement/program-summon.html

I suppose that very few people have had to go through them, there's very little info on this board about them. A quick Google search, though, shows a lot of complaints, and they're being sued.

Hopefully this helps.

Are they violating the FDCPA? How are those threats being worded, and in what tone? In what way are their actions construed as harassment?

As far as I know, Hunt & Henriques is a collection law firm that might have bought your debt. If they have not send you a collection letter till now, you can pull out your credit report check whether their name is listed in your report. If you find their name in your credit report, you should send a debt validation letter by certified mail to check whether they actually own your debt or not. If they can properly validate your debt, you can come to a repayment plan and pay it off. You can send debt validation letter at the following address:
151 Bernal Road Suite 8, San Jose, CA 95119.

You need not worry because even if they take you to the court, they must validate the debt before they can bring judgment against you. If they fail to validate the debt in the court, the judgment will go in your favor. However, if they do not validate the debt, but still harass you over the phone, you can send them a cease and desist letter. But before sending a cease and desist letter make sure that you do not owe them the debt.

good post guest, but the consumer can still owe the debt.just not to them.it is up to the CA to prove this.alot of JDB'S or even scammers can buy info as seen on some threads.again good post, but the CA must prove there legal rights to collect.

In response to chrys, they are basically calling everyday, the times I answered, they said they would file a judgment against me.

PaulM

on my creditreport, it doesn't show Hunt & Henriques at all, but shows Loan Type: Collection Agency Attorney

also shows originator was GE, and on top it has ARROW FINANCIAL SERVICES

So any suggustions on how I can handle this?

arrow is a pain in the tuckus to deal with.there should be an address on your CR.send them a DV letter asap.send it certified mail return receipt.in the meantime dispute the entry.just let the CRA know that this is a payday loan.i did that with AIS and they deleted it.

PaulM, your information is much needed & appreciated, thank you.....

ok, sorry for sounding naive, honestly I am oblivous all of this, for starters, I send them (theres an address on the institution listed on my cr), a DV, certified, then what?

Also, forgive me for asking (another brainfart), what is CRA (the collection agency?) and by letting them know its a payday loan, what will that do,

thanks kindly again

Hello....ok my consumer debt of $7,000 was apparently bought by H&H and they want to settle for $3,760. The original creditor was sears, then midland funding and finally H&H who has also shwon up on my credit report. The last payment made to the original creditor was 10/17/2007. I am in the sate of CA. I had also requested something in writing about the settlement and they wanted to e-mail or fax instead and were giving me a very hard time when I would request it by mail?

Oh...by the way, when i was asking them for the written statement of settlement, the agent i was speaking with was very rude...he said "why don't you trust us enough just to pay the debt off over the phone, if we were really untrustworthy we would have already levied your bank account." to which i replied, "you can levy my bank account w/o a judgement from a ruling in court?" he said "yes"...can they really do that?

Hunt & Henriques is a scum ball law firm. The courts are in bed with the lawyers. The courts allow the scum bag lawyers to do whatever they want. The clerks cater to the lawyers. They stamp documents like Writs of Execution for the lawyers even when the case is not even over! The lawyers in turn send the Writs along with Notice of Levy to banks.

I hope Mr. Hunt gets his ass kicked in court.

No debt collector has permission to use your SSN and if they do they should be reported to the police for doing so if they keep their fraudulent debt collection activity up.

I have just been summons to court be Hunt & Henriques. Did not know that this was going to happen! Made arrangements for payments and was not given enough time to start them. They are a rip off!
