Hello, I've been reading this site all morning, here is my situation.

I had a cc with Sears/Citibank, I fell on bad times almost 3 years ago, I couldn't make the payment due to one late fee.

I've had calls from several collection agency's during this time, 2 different ones all in the same week looking to collect on the same debt, so I didn't know who was entitled to actually collect this.

Yesterday I got a summons for our District Magistrait to appear in court May 5,2009, I panicked and called the Magistrait's office and the lady said that they could put a lien against my home and also do a sheriff sale of all my personal belongings!
So I quickly called the 800# to see if there was anyway to settle this.

I spoke with a guy named Angelo, who said they would accept $100 a month for the next four months(I gave them my account # and authorized them to take the 4 monthly payments) but he said that the court date stands and that they would still seek the judgement anyhow, and that I can goto the court hearing "if I want to"..... what the hell does that mean??? if I want too??

I'm so confused, I live in PA, can they actually march into my home and sell my things, can they freeze my bank account when its a joint acc with my son on there as the first person? Can they put a lien against my home? I have 3 beagles, can they sell my dogs too?

We barely makes ends meet as it is, there is no way I can afford a lawyer. PLEASE HELP


First of all, DON'T ever give them your account information, they will drain your account. Close that account ASAP and open a new one.
Secondly, they can't take anything without first getting a judgement against you.
Even if they get a judgement, the judge can set the payment amount.

If I close out my account, can't their local lawyer use that against me on the court date as me addmitting the account/debt is mine? It is my debt, I do want to pay it and get it off my credit. Its just when the court clerk said it was better to try and settle this because they could put a lien against my home and or freeze my checking account and or even do a sheriff sale of all my things I freaked out.
But what has me even more confused is, if I'm entering into a payment arrangement, shouldn't they dismiss the upcoming court case???? They will have 3 payments with 1 more in June.
If I'm paying, why still take me to court?

Question, if I close my account, I can't afford a lawyer, how do I present my side? What do I need to say in defence of myself? Will their 'local' lawyer even show up? And will he have all the proper papers? I've read a few sites that say they can't prove most of their cases and hope the defendant (me) doesn't show up and that they can win by default.

Arrow financial services would need a court order, which would need a judgment, which would need a lawsuit.

Is that your only unsecured debt? Have you considered bankruptcy? If that's your only unsecured creditor it's probably worth hanging on for a settlement offer that you can afford. How late is it? Which collection agency has it?
