I had been unemployed for the past five months and am delinquent on my Mervyns account. I've been contacted by two different collection agencies: Encore and Allied. Can Mervyns (G.E. Money Bank) contract my account for collection with just one collection agency at a time? Encore had all my credit infor., SS#(last five digits) both companies had been calling for the past month continously). When Allied called (the day after my I made the settlement agreement with Encore), Allied said that the account can only be settled my them. I called the number listed in my Mervyns statement and they won't answer my question as to whether or not they contract with both agencies. They do, however, refer me to a telephone number and that number belongs to Allied. However, they won't answer my question as whether or not Encore represents Mervyns as well as far as collections go. What is your opinion?


The only way to be sure about the collection agency that owns your debt is to send a debt validation letter by certified mail to both of them. The collection agency who can properly validate the debt owns your debt and so you can come to a repayment agreement with that collection agency and pay it off. As a proper debt validation the CAs must provide you with a copy of the original signed contract, the details of all outstanding bills and proof that the collection agency has purchased the debt from the original creditor.

Sorry but this is totally wrong. They don't have to provide any of that per the FDCPA. Read sec 809. I'm not sure where you're getting your info from but you have posted incorrect info on many of your posts. You might want to download a copy of the FDCPA and read it.
