First is there only 1 Encore? I got a call from 801-943-0000. The call was generated from Holiday Utah. I answered and they stated they were attempting to collect a debt for Mervyns. I asked for a written notice of the debt and she stated that it was sent out. she said either on March 4th or March 14th. She was talking so fast I could not understand her. Either way I have not received it. I told her not to call anymore until I get the written proof. She stated the calls would keep coming even though I requested them to stop. I have found useful info from your site! But am still a little cloudy on the laws. If I do get written verification from them and send a dispute letter, how long until they stop calling? Can someone help me through the process?

You can get them to stop calling immediately with a letter that tells them to stop calling. You can include this in a DV letter. What they will likely send is just a print out of what they say you owe, but by law that is required as a initial dunning letter. If you did not receive it, then send a DV letter and note that, also include a line about them not calling you at all. Make sure the letter is certified mail, return receipt requested.

I don't know their proper address since the call is originating from Utah. She hung up on me before I could ask for the address because I told her she had to stop calling me until I got verification. I hate rude people. I will be recording their calls and it is legal in California if I inform them that I am recording the call. It is THEIR choice if they want to continue with the call or not.

No no CD letters yet. I'm still not bothered enough to justify spending the money for a CL RR letter. It really does bother me that I have to spend money to prove my innocence even though I proved it over the phone and both parties agreed they had the wrong person.
