I need help with my payday loan - NOT PAYING THEM!

I have had a payday loan with mycashnow.com off and on for over two years. I have always paid them back. But this time, I cannot. After reading some of your posts... I understand because I'm in New York State, I may not have to pay them back? Please help!?

They were able to debit my account for the $82 interest, (and overdrafted my account) but my bank denied the $440 debit. So mycashnow.com has emailed me saying they want their money. They want $440 plus $25 for the returned fee.

What am I to do now?
Go close my bank account? How can I if it's in the negative? Can I ask them to just give me a new account number?

How do I keep them from calling my work? I'm so scared they will call my job.

What else should I do?

Has anyone ever had any luck with them refunding overpayments? I am not confident I can just send a letter asking for my $3500 back and they'll just say "okay" lol

I have had over $1500 refunded to me by PDL companies and I live in VA. A little advice to help is you have your state laws on your side and you have your DFI in your corner. Also remain persistent. File all the neccessary complaints with your AG, BBB, and DFI. This will give you a little more leverage. :wink: Best of Luck!

Queen you are not alone like nohiogal stated we have all been there. I have never added up the dollar amount I have over paid these companies because I dont want to know, I am sure I would make myself sick. Ask for a refund but if you dont get it move forward and dont look back. Just know you will be pdl free and how good that will feel.

Everyone talks about sending "The letter" but I'm not finding the letter I should be sending these people...
Can someone please help me what the best letter to send out is?
Thanks. I called the bank and I have to go in in the morning and do the permanent ACH block - it will cost me $15
I told them it was for an illegal payday loan, but they didn't seem to offer any other advice? Thanks.

I'm confused about one thing - the NY State law says:
Licensed lender law applies but interest rate is that agreed to by contract. N.Y. Banking Law ?? 340 et seq. A check casher licensee cannot make loans nor cash or advance any moneys on a post dated check unless it is a payroll check. N.Y. Banking Law ?? 373. Criminal law sets the usury cap at 25%. N.Y. Penal Code ?? 190.40.


So isn't this saying that because it IS a "Paycheck loan advance" then it IS okay to do in New York State?

It is my payroll check that they are "loaning" me on...

You can read more here.

That link is to the New York state department of banking and the information on payday loans.

The loan is on an ACH withdrawl from a bank not your paycheck. You paycheck may be deposited but the PDL does not know or care where the money comes from they are only debiting a bank account. That is a payday loan and is illegal.
