Man..this made me laugh out loud!

So I have an account that was a GE Capital/Walmart card. Settled on that account when I was in a debt settlement program. Well GE sold off the remaining balance to LVNV...but that's not the funny part.

Received a dunning letter from Central Credit Services trying to collect on it. Sent off a fax and certified DV letter to them March 7th.

Today I get a dunning letter from Resurgent Capital. Here is the funny part. The dunning letter states, "Enclosed please find an original validation of debt that verifies the debt".

Enclosed is a second page. Not even any letter head on it that only states:

Validation of Debt
March 13, 2009
(my name)

Account number xxxxx for (my name) acquired from GE Capital is now owned by LVNV Funding LLC.

At the time the account was acquired from GE Capital, GE Capital advised that the balance owing was $1,031.31. Since that time, additional interest, fees, payments, credits, and offsets, if applicable, have been allowed, for a current balance of $1,039.23.

Ummm...yeah. That has got to be one of the lamest "original validations of debt" ever!! Seriously, why would they think that would pass as an adequate validation of debt?

These guys almost make sending out DV's fun!


new to this stuff trying to learn...so a ca can sue you? Just had asked a question about sending out a validation letter and now I have my answer...to always send out a letter asking for validation,but how do you know if you are getting a "proper" validation? I am sending out a validation letter tomorrow to NCO following the guidelines from this site.Do they have a certain time to get back to you?

CA's generally do not have the standing to file suit. They would need to assign it to a DC Attorney. Always DV, you need to find out who all the players are and that is the only way. They do not have a time limit to respond to a DV (unless you live in TX = 30 days), but if the DV is timely, w/in 30 days, collection efforts must cease until validation is provided.
