Need PDL Help in CA..... PLEASE!!!

Hi..... I currently have the following loans:

ACC / The Cash Spot
Borrowed 300, paid 535, they say I still owe 187.50

Clearwater Bay Marketing / Namakan Capital
Borrowed 300, paid back 810, they say I still owe 390

Eastside Lenders
Borrowed 300, paid 735, they say I still owe 195

National Cash Lenders
Borrowed 300, paid 655, they say I still owe 105

PayDay Max
Borrowed 1000, paid 452, they say I still owe 1186

Cash Transfer Centers
Borrowed 1200, paid 0, owe 1524

Cash Central AND CashNet USA AND Ace Cash Express
Borrowed 255, owe 300

United Cash Loans
Borrowed 300, paid 90, they say I owe 390

3B Payday
Borrowed 300, paid 180, still owe 390

Payday Loan Yes
Borrowed 350, paid 210, still owe 455

I can not afford this anymore. I feel so dumb for getting in this trap, but I need out! All of my payments defaulted last night, so I am expecting this to all blow up soon. I need help on where to start to take care of this. Is is possible to do this all on my own? I thought of hiring a company to help me but they were going to charge me almost 2000 for their assistance and I would rather put that money towards paying off these debts in a faster time. Please help me!


Almost all of those are illegal/unlicensed.

Some I will need to do more checking into.

You can do this by yourself and should because they are illegal you have already paid some of these off.

For illegal lenders you only owe the amount borrowed.

Let me do some checking on the companies I am not sure of.

You can do this on your own and as nohiogal stated most of your loans are illegal. I know she will be back with her findings. When I first started the process I had 15 loans so please do not feel stupid we have all been there and we are not here to judge anyone just help as many people as we can realize they are not alone and there is help.

You do not need to hire a company. Hang in there.

You will need to close you account.

You can go here and start reading up on the steps to take when dealing with illegal lenders.

We can help guide you along the way.

It is really better if you do this yourself as illegal lenders do not usually work with consolidation companies. If they do they want the whole amount that they are not legally due.

ACC / The Cash Spot, Clearwater Bay Marketing / Namakan Capital, Eastside Lenders, National Cash Lenders, United Cash Loans, 3B Payday, Payday Loan Yes.

All those companies owe you major refunds geez. Please, please close your bank account ASAP.

You will need to contact the LEGAL lenders to try and set up a repayment plan. If you borrowed $255 from all of them, then you can hopefully set up an EPP to break up the payments. So you are looking at about $75 for each loan every payday.

Definately secure your account first so you can gain control of your funds.

Ok.... I just have a few questions.

I have been reading about how to deal with the illegal / unlicensed lenders. I am terrified that they will contact my family or place of employment. Once I send the letters telling them to only email me or correspond by mail, will they comply with that request?

If I do set up payment plans with the legal lenders, I won't have enough money to paydown the other (unlicensed) lenders the rest of the principal I owe for about a month and a half. Will they wait that long?

On the ones that I have overpaid..... is it hard to get them to close my account as paid?

They will not comply. They are illegal and will try all kinds of threats and scare tactics.

The ones you have overpaid may give you a PIF and then they will stop calling. Others are harder to deal with.

If you are worried at work I would explain that you are a victim of fraud, not a lie, and that you are working with your bank and getting your account closed but these companies are harrassing you for a debt you do not owe.

I would always deal with the legal lenders first. The illegals ones can just wait.

Agreed, the Legal lenders needs to be tended to first before you default.

Your Illegal lenders are all overpaid. So you are done with them. Do not worry about paying anymore fees. They are not licensed in your state and most are ILLEGAL period. Meaning they do not even hold a valid license to lend.

However when you stop paying the Illegal lenders they become aggressive in their collection tactics. Read THIS for dealing with Illegal lenders.

One of my loans says "Namakan Capital" on my bank statement when the recurring fee of 90.00 comes out every two weeks. i seem to remember that originally the person who called me referred to their company as Clearwater Bay Marketing. Has anyone else dealt with this company? Are they the same?

Most legal lenders will be they can be snotty about it. Since they can't get their money through the ACH they are more willing to work with you. Most want new bank information but do not give that to them. The best way to make payments is with a prepaid Visa.

Clearwater is unlicensed as well.

Cash Transfer Centers, along with all of the Sonic Companies, have been banned by California from doing loans to residents. So this means that not only is this loan illegal, they committed an infraction even lending to you!
They are going to harass you and try and invoke their wage assignment letter, that I am sure you signed to get the loan. This was the one that gave them permission to go into your check should you default. You need to immediately revoke that letter with your HR or Payroll person. That should be the first thing you do at work tomorrow. They are famous for that letter, so I would do that first thing.
If they threaten you in anyway, immediately file a complaint with the California Dept of Corporations--who will be interested to know that Cash Transfer Centers is loaning to California residents, I am sure. Keep us posted, OK?

Ok....

So far I have been bombarded by calls from Cash Central but I am not answering them. I sent them and email requesting a payment arrangement. No response yet.

I got an email from 3B about the missed payment. I sent them an email similar to the suggested letter found in the sticky about dealing with illegal internet PDL's. I told them I would repay the principal amount owed by MO if they give me the address. No response yet.

I also sent similar emails to ACC / The Cash Spot, Eastside Lenders and National Cash Lenders... but since I have way overpaid them I requested my account be marked PIF and that I be sent a refund of the overpayment. No response yet.

I emailed Payday Max and CTC, telling them a lot of the same but since I still owe them some principle I offered to make payment arrangements through the mail or by Visa (prepaid). Also no response yet.

I got an email from ACE Cash Express saying that my loan is in default and is being sent to a collections agency called CSO. Has anyone dealt with them?

Any other suggestions?

I am in the process of going through this myself. I sent letters via fax & email to all of the PDL that I had (7) and I follow up everyday. I know they have recieved my letters because I can no longer log on to my accts via internet. So I will keep you updated and let you know how it is going with me ( I too, live in Ca). Now, I do have 2 legal loans (Cash Central & Pay Day One), both were very friendly and allowed me small extentions to payoff my balances. Cash Central canceled my ACH and I am paying them via Money Gram and Pay Day One 'extended' my due date and IF I don't pay then will do ACH withdrawl. I DO plan on paying these first since they are legal and were so very cooperative. Now, as for the illegal ones, this remains to be seen. I have over paid 3 of the 5 illegal and 2 of them I have not over paid. I am willing to pay the $86 on one and $110 on the other to equal the amount owed but thats it. I will pay my initial amount but not their rollover fees. Good luck and keep us up to date. Maybe between my experience and yours we can help each other!
PS- I have a question for you- one of my PDL is with Payday Max. Does anyone have an actual email address for them. All I had was a fax number.

Just an update:
I got an email regarding Eastside Lenders..... they said that they can not refund me the amount that I have overpaid but that they are willing to settle the account for $100. According to them, the balance that I owe now is $250, but if I pay the 100 they will mark my account PIF. I emailed them back and said that, since their loans are illegal in the State of CA, I no longer wish to engage in illegal transactios with them and if they can not refund me any money then at least they could mark my account as paid in full. My original loan amount was for $300, now, after paying them $735, they say I still owe $250? Has anyone else dealt with this company?

Another question:

Everyone here receommends that I not only send the lender my wage assignment revocation letter, but also to send a copy to my payroll department. Well, I work for a LARGE employer (fed gov) and trying to find the right place to send that is a nightmare. Has anyone had experience with this?

I have filed reports with the BBB online for a lot of the illegal lenders, although I don't know if that helps. I also started filing complaints with the State of CA Department of Corporations for the illegal lenders. This is very time consuming.... but I admit I feel a lot better about this than I did a week ago knowing that I wouldn't be able to afford this weeks payments. I appreciate all the help you all have provided me with. I wish I would have done this sooner. I hope this works.

Another update....

Payday-Loan-yes called my boss at work. They left a message stating that they are from "First National" and that they are calling about me. I had already sent them the email telling them not to contact me or anyone else by phone. I just filed complaints with the BBB and FTC about them. I will next file a complaint with the CA Dept of Corporations. I have been reading the HORROR stories about people dealing with PDL Yes and First National Services......... has ANYONE had any success? Any help is appreciated!

If your boss is cool about the call then good, but if not you can always say there was fraud on your account, which is true, and there is now an illegal company seeking to take your funds and that you are working with your bank to clear up the matter.

I have never worked with that company, hopefully another member has that can give advice.

Another Update:

I received another email from Eastside Lenders, just a standard "you missed your payment" email. I filed a complaint with the BBB and from what I read, they actually respond to these complaints, so maybe that will work. I emailed them back and AGAIN explained how I had already overpaid them.... etc.

I was getting calls from Credit Protection Depot (PayDayMax). I called them and explained to them that, since I had originally taken a loan for 1000 and already paid back 452 I would only pay them them 548 I owe since they are unlicensed. The woman on the other end just kept telling me that "this is a payday loan, ma'm, and you need to pay this off on your next payday." She did say that they would accept a payment of $1000 to settle this, but I would never be able to use their services again (oh, darn). I had been on the phone for so long, that I agreed to the arrangement. She said she was going to email me the info for MoneyGram so that I could make the payment.. but it never arrived in my inbox. Then.. I got to thinking that it was not a good deal, in fact.... that would still be an overpayment of 452 for a loan that was ILLEGAL in the first place. So, I figure that I will send them the total of 548 that I owe them, and go from there.

I made very agreeable payment arrangements with Cash Central, they are good to work with.

I still haven't heard anything from United Cash Loans, 3B Payday Loans, ACC / The Cash Spot, Namakan Capital, or CashNet USA.

Another Update:
I have made favorable payment arrangements with the 3 legal lenders (Cash Central, Ace, and CashNet USA).?? I have to pay them off over the next two months.?? I am ok with that.. at least they will be gone buy May.
I have gotten one call from United Cash Loans.?? They also sent me an email stating that since I have been such a good customer I am eligible for another loan (??????)?? I don't get this because I havent paid off what I owe.?? I didn't call them back.?? I will continue to send them the letter stating that I will just pay the remaining principle that I owe.
The Cash Spot sent me another email stating that they are unable to deduct the "payment" from my checking account, but as a courtesy they will re-deduct the payment in two days (oh gee, thanks).?? I re-sent them the email stating that I have already overpaid them and I would like a refund.?? No response.
Other than that, I haven't heard much in the way of phone calls.?? Is this the calm before the storm??? It's been a week since I defaulted.

Don't sweat the illegals. They can say nothing for months and then come out of the wood work like roaches.

I got the letter from CTC today....... telling me that the contract was done under the laws of Malta, not the State of CA where I live....... and that they will take payments towards the 1200 that I borrowed as long as the payments are made by 6/29/09. Should I take it?

Also.... got the "Tim Atkins" email from Pay Day Loan Yes.

Oops... I didn't sign in on this one or the last... but it's me. I technically did not pay them anything on the loan that I originally took out so TECHNICALLY I do owe them the entire 1200. I guess I should pay it... but I just feel so ripped off because after going through my bank statements I see that I have paid them almost $4000 in fees over the last six months. Since the loans were paid off each payday along with their outrageous fees.... it looks as thought i have not paid anything against the last 1200 loan that I received from them. Man... I really feel terrible about this but I will be glad when it is all over.

Definately send them a letter stating by your state laws the $4000 in fees were Illegal and you are considering your loan PIF. Also I would demand a major refund. That is alot of money, and in no way should you feel bad. They would have never stop you from paying those rollover fees. It could have got up to $10,000 then what.
